New Delhi: The Delhi High Court on Wednesday stayed a Delhi government order reserving 20 percent seats in St Columba's school for students belonging to the economically weaker sections.
Justice Manmohan passed an interim order staying the government notification, which he said "has been passed without application of mind".
St Columba's moved the high court challenging the December 18 notification of Lt Governor Najeeb Jung, saying the Supreme Court had excluded minority schools from the ambit of Right to Education Act.
The apex court held April 12, 2012 that the act would not apply to unaided minority schools and imposing a quota for children from poor families on such schools violated Article 30 of the Constitution.
Jung is an alumnus of St Columba's.
On December 18, Jung ordered all the schools in Delhi, including minority schools, which got land from the government, to also admit 20 percent children from the weaker sections in the neighbourhood.
Delhi government counsel Zubeda Begum told the court that in 1966, land was given to the school on concessional basis so that they kept 20 percent of their seats to the economically weaker sections.
The association of unaided private schools has also moved the high court challenging the Delhi government notification. It has called the order "absolutely illegal, arbitrary and without jurisdiction".

So its basically HC has ordered NO 20% EWS quota for minority run schools (read all christian schools). This is the first major setback for all parent community.
Hope the dissolution of the management quota is also not stayed.
does it also mean that, new point system of 8 km. will not apply to christian schools? and they are free to have their own critieria.

This is only for ews quota nothing related to points system.
Does this mean more seats for Gen Cat (read Christians, if not filled by Christians then spill over to Gen Cat ie any religion) in minority schools ?
This case as it seems was filed only by St.Colamba's against LG's order.
Is the case filed by the Schools Asso. seeking stay on LG's 18Dec2013 order a different one from the above ?
this unfortunate ruling will allow other schools to behave in similar fashion and once again judiciary comes to the rescue of the corrupt
What about the other case filed by Schools regarding Management Quota?
When any specific sect opens an institution, it has a specific motto to which their action plans are formulated. Govt. is encouraging minority section of the society through various welfare schemes for them. On the other hand, many steps/activities/missions are also being undertaken by the minority communities itself.
So is the case with minority schools. These schools are in fact providing education to upbring their society educationally. In another words, they are already in the service of a cause. So why reservation for another marginal section in their institutions?
I concur with the HC order and stay.
