High court allows unaided pvt schools to collect quarterly fees

NEW DELHI: In a major relief to unaided private schools in the Capital, the Delhi High Court on Thursday set aside its own direction of restraining schools from levying fee for more than one month at a time from students.

A bench headed by acting Chief Justice BD Ahmed, however, considering the grievances registered by some of the parents, said the parents may individually make a request to the school authorities to allow them to pay the fee on a monthly basis.

“When such requests are made, the principals will deal with them compassionately and reasonably, so that no student is affected for non-payment of quarterly fee,” the bench said.

The HC’s order came after the counsel appearing for the private unaided schools assured the court that they were willing to accept monthly payment of fee from all those parents who find it financially difficult to make quarterly payment.

The private schools had approached the HC contending that the Delhi School Education (DSE) Rules, 1973 did not restrict them from collecting fee for more than one month at a time from students.

In April last, a single judge bench of the court had ruled that schools were not entitled to seek deposit of fees from parents for more than one month, as per the DSE Rules.

The court had said that the Director of Education had no authority to allow these schools to charge the fees for more than one month at a time.

The action committee of Unaided Recognised Private Schools, in their petition challenging the verdict contended that, “The rules (fee norms in the Delhi School Education Rules) are not applicable to unaided schools.”

New Delhi: In a relief to schools, Delhi high court on Thursday reversed its earlier order which had held that private unaided schools cannot take fees on a quarterly basis.
    A bench of acting chief justice B D Ahmed and justice V Kameswar Rao sent the matter back to a single judge, asking
him to hear it afresh, since certain points were not considered by him earlier. The HC’s order came on an appeal filed by the Action Committee of Unaided Recognized Private Schools which had challenged the order passed by the single judge in April last year.
    The school association argued before the division bench that the power under Delhi School Education Act 1973, which
allows the government administration to make rules with respect to fees and other charges, is confined to aided institutions and not unaided ones.
    It maintained that the rules, which state that schools can collect fees on monthly basis and shall levy a penalty of five paise per day for each day’s delay in payment, are not applicable to unaided schools.

New Delhi: The directorate of education has asked all schools which were given provisional recognition in 2013 to furnish data of students in Class V and VII for its “admission plan”.
    In 2013, the previous Delhi government had relaxed land norms to make hundreds of schools eligible for recognition before the deadline for the implementation of the Right to Education Act 2009. Unrecognized schools aren’t allowed to run under the act.
    Of the 667 schools that were granted provisional recognition, 324 are primary (till Class VIII) and 343 are elementary (till Class V) schools. Padmini Singla, director, education, says: “We want data so we can plan for these kids. When they graduate they will be attending our (government-run) schools.” Typically, schools are assigned area-wise. According to the department’s own estimates, enrolment in government schools is increasing by a lakh every year but the number of schools is not going up at the same rate.
    However, Singla and private school management bodies don’t think accommodating these kids will be a problem.

I would say wait for court orders but i think if parents request ,they have to ag@ree

@Khushboo,Admissions will start after court proceedings and then only we will start again.

Hello Sakshi Ma'm,

Can we still pay monthly fees or school can now force us to pay quarterly which won't be convenient for parents like me paying 10K per month?Please advice
