Petition challenges upper age limit for nursery admission

Parents with kids older than four years are finding that many schools have fixed the upper-age-limit anyway and they are ineligible to even apply.

NEW DELHI: A petition was filed in the Delhi high court on Thursday challenging the decision of a private school to fix four years as upper age limit for admission in nursery class.

The petition, filed by the father of a child, alleged that a notification of Delhi's directorate of education (DoE) mentioned three years as the lower age for admission in nursery and categorically bars unaided private schools from fixing any upper age cap for this purpose.

The plea, however said that Sachdeva Public School at Rohini, in its admission brochure, said that children, who are of three years of age and have not crossed the four year age limit, would be entitled for admission in nursery.

The petition sought an order or direction declaring the clause 5 of admission criteria for pre-school issued by the school for the session 2013-14 about fixation of upper age limit for admission "arbitrary and illegal" and striking down the same.

The petition filed by Pankaj Kumar, through advocate Ashok Agarwal, alleged that the school has refused to accept the application form of his son on the ground that the child would be over four years of age on March 31, the cut-off date for receipt of forms.

The case likely come for hearing Friday.

Pusa road is accapting

My  daughter's DOB is 31.03.2010, she is going in play way and she is too young to join nursery everybody says. Even staff at reception of schools are also eacaping giving form to that young children.

But what will happen when she will be over age next year..we will be sailing in the same boat as the petitioner.

Hoping for a positive decision of Court on the same.

@ Arun

I would advice you to apply for this coming session since he is eligible for nursery admission and next year it would be very difficult to get a nursery seat.

ya, thats 100% true. because last yr my son is also looks very younger to admit in nur but now i faced many problems to send him to nursery no one is accepting our form.

Breaking News- Sachdeva School Agrees to give Admission  to 4 + Child in Nursery

Rest we will we update you on the following thread after seeing the copy of judgement soon.

Mam even sanskriti school, chanakya puri is having age cap . Accepting only children born between 1 apr 2009 to 31 march 2010. There there is same criteria even for children with special needs

That is a big relief for the parents of the children above 4 years. I just want to know that did Hon. High Court has given a judgement regarding that or not. If yes, then will DOE will issue the guideline to the schools regarding the same and by when, because the last date for submitting the application form for nursery is very close. And when we can see the copy of judgement?

This is ridiculous. I went to St. Marks girls school in Paschim Vihar to take the admission form, but they denied saying that kid is 4+ and form will be only issues if she can take admission in nursery with a undertaking from the parents not to force the school for higher class in future.

I can't understand when she is already in nursery in play school, what is the point of nursery admission again.

SEE THIS IS SCHOOL SPECIFIC , BUT  SO WE CAN NOT TAKE GRANTED THAT ALL SCHOOL WILL FOLLOW UNLESS SOMEONE APPROACHES COURT FOR ALL OR RESPECTIVE SCHOOLS. BUT YES THIS HAS SET PRECEDENT.
