Parents of nursery kids welcome end of suspense

NEW DELHI: The high court's decision on nursery admissions, upholding the lieutenant governor's order at least for this academic session, has been welcomed by most parents. Many of them had been dreading yet another round of planning. Directorate of Education, assuaging fears that frequent delays will leave less time for applications, issued a new schedule on Monday. Admissions will begin on January 21 and the last date for application is February 5.

"This is excellent news for all parents. Hope the form distribution and submission begins shortly. Please update in case anyone has heard about North Delhi area, thanks," writes a parent on admissionsnursery.com. Another writes, "Finally. Rocks" and a third, "Nice. Relaxed now". Also, this time, DOE is allowing schools to issue more lists, if required, between March 17 and 31.

The 20% management quota is gone; the existing quotas are for economically weaker section/ disadvantaged groups (25%), girls (5%) and staff (5%). The rest are general category seats. The parameters over which the 100 points are distributed have been fixed - 70 for neighbourhood (8km), 20 for sibling, five for alumni and another five for transfer cases.

The schools bodies that had challenged the order, will file an appeal in the Supreme Court and are hoping the matter will come up for hearing on Friday. But even members of Action Committee for Unaided Recognized Private Schools and other schools party to the case will have to start admissions on Tuesday.

"We are unhappy with the order and will file an appeal. The Delhi government will notify the process for this session and we'll follow that. We have to," says S K Bhattacharya, president, Action Committee. Admissionsnursery.com's Sumit Vohra says there is still anxiety over the appeal in SC.

Following the LG guidelines -regarded by a sizeable section of the parent community as "pro-parents"-will present certain logistical problems to schools. "There will have to be lotteries on every parameter," says R C Jain, president, Delhi State Public Schools Management Association.

"Earlier, EWS lotteries were difficult to manage. Police had to be called and video coverage organized. Now, with lotteries on every count-5% girls' seats, staff, siblings and alumni too as there will be many more now -schools will have a really tough job calling parents several times," he says. He is anticipating "so many complaints" that "the government won't be able to handle them all".

In a setback to unaided private schools, the Delhi High Court on Monday dismissed their plea seeking a stay on the government’s new nursery admission guidelines. The guidelines scrapped the 20 per cent management quota. Nursery admissions in the capital will now begin from Tuesday.

Observing that the schools had “not been able to satisfy us of any irreparable loss and injury to them” if the stay orders were not issued, the bench of Chief Justice NV Ramana and Justice RS Endlaw dismissed the plea for injunction.

The schools had approached the court, challenging the guidelines, which had fixed parameters and points for admission to a class at entry level of the school. Schools are also prohibited from fixing additional points other than those specified. The Action Committee of Unaided Recognized Private Schools and the Forum for Quality Education had challenged the orders before a single bench of the High Court and had sought a stay on the operation of the notification while the case was being heard. The schools had demanded that this year’s admission process should not follow the notification guidelines.

They had approached the division bench after the single bench had declined to issue a stay order.

The main plea, which challenges the guideline issued under the L-G’s notification will now be heard by the single bench in March.

The court held that the “interference at this stage would create confusion and would be detrimental to the interests of children as well as parents”. “Notice can also be taken of the fact that the number of admission seekers is much more than the seats available in the schools. The same leads to elaborate planning on the part of the parents for arranging for admission and any uncertainty in the rules of admission is likely to cause grave prejudice to the parents,” the court held, adding that the stay order was not in public interest.

The Department of Education has also extended the last date for submission of admission application to February 5. Schools will display the first list of selected candidates on February 28. The entire procedure will end by March 31, as planned by the department earlier.

Disappointed with the order, the schools plan to approach the Supreme Court. “Yes, we are disappointed. We were hoping to get some relief from the High Court. As a last and final effort, we will now approach the Supreme Court in a couple of days,” S K Bhattacharya, president, Action Committee for Unaided Recognized Private Schools, said. “Our fight is not against the point system, but for the schools’ autonomy. Right now, the government is controlling the entire admission process. They don’t have the power to do that,” he said.

School principals also expressed their disappointment over the verdict. “With this order, the autonomy for private schools has become a myth,” Jyoti Bose, principal, Springdales School, Dhaula Kuan, said. Parents across the capital have welcomed the High Court order. “We are very happy with the court’s decision. It’s great for parents who can’t pay donations to big schools. It is fair and in the best interest of the education system,” Sumit Vohra, founder of website admissionsnursery, said.

Hi. . I thought the managememnt quota was completely abolished. I see in the points system that 5 percent is for staff quota is still there. Can u please clarify what this means. . Mr. Vohra? 5percent translates into many seats when every seat counts. Please clarify.

That 5% given by LG strictly to the children and grand children of the school staff only, 

but i agree with you this can be misused .

The Hon'ble Judges had asked the appellants (schools) what irrepairable loss they would suffer if managment quota is abolished...

Mr. Vohra ... I wanted to raise a very disturbing trend in nursery admissions. I dont know whwn will the day come when someone will address this. My only hope is you. Delhi schools lay so much emphasis on distance. .. Neighborhood etc that its impossible for any noida ir gurgaon parent to aaply in delhi school. Whereas the top schools like step by step noida. . Dps noida etc do not even consider this as a factor. Most seats in these schools are occupied by delhi kids whereas noida people are not even considered. Why this injustice. Mr. Vohra pl. Increase the scope of ur activities from delhi admussions to noida n gurgaon. No delhi parent should be allowed in noida schools. only noida parents shud be considered.

IIRC: LAst year Mr.Vohra had taken on a well known school from gurgaon in an DOE haryana forum.

that rules is for EWS not for general as i could see website and which standard rules for lottery of EWS.

Hi. I'm filing forms for springdales dhaula kuan .. But they r giving points for the distance in km for house to school And not considering the radius ..Is this the way we measure it??? I had a diff. Concept in mind ... Please suggest

even HC allow to follow given guidelines as ordered, but most of school have no effect, they  do as they want. what should we do? , how we can stopped them?

St. Joseph (Preshcool) in east delhi not issue the admission form till coming 1 fed 2014, they distribute the form 8am to 11 am and close the same day of process of distribution form, the people start the line before a day and whole night keep in line....
