SC SAYS NO to staying HC order, next hearing on 31 jan

The Supreme Court (SC) on Friday refused to grant a stay on the Delhi High Court's order on nursery school admissions in Delhi, allowing the process to continue for the time being. The apex court has, however, deferred the hearing to 31 January, which means if it strikes down the guidelines later, it could create problems for parents.
While expressing concern about tweaks in the nursery admission guidelines, a parent Raman Singh said: "I am worried about changing guidelines. At the same time, I also feel that schools do deserve some autonomy in deciding the admissions. They are after all private unaided profit seeking institutions. Government does not advice other businesses like restaurants and shops which clients they should accept."
But the SC decision has given relief to some parents. "I am happy that at least the admission process will continue. Fed up of the daily drama with no end in sight," said a parent.
But, some of the schools claiming about the chances of  tweaks in guidelines are leaving the parents confused. "The entire admission procedure and criteria are provisional and without prejudice and are subject to modifications based upon any Order / Direction/ Judgement of the Hon’ble Supreme Court of India," said a school notice board in south Delhi.
Jaya Chakravarty, a parent from south Delhi said: "Is this ever going to be final or this year onwards, these rules will follow. How much these school associations value for the education of toddlers. For them manipulation of rules for profit is the priority, quality education is secondary. Moreover, these delays will affect the education of these children."
Another parent Deepak Jain said: "So, should we stop submitting forms in the school because guidelines may change after court verdict?"
"No more changes at this point of time. We have been running from pillar to post, filling applications, making DDs and if the verdict is unfavourable, we will suffer," said Neha Tyagi, a parent from west Delhi.
On the other hand, education activist, Sumit Vohra said: "It's not a win-win situation for parents as many parents feel the tables might turn later and some are skeptical about some big schools which were earlier giving online admission are giving physical forms which might lack transparency. Parents are confused whether to fill forms or wait till 31 January for the hearing as some of the schools mentioned this either on their notice board or website that admission guidelines are subject to change. Some parents fear that admissions can be cancelled if these schools get an order in their favour from Supreme Court."
However, Lathaa Manavalan, founder of an Infant Education centre said: "Well expected and good decision. Again our fundamental rights are protected and hereby more chances to less affluent citizens. RTE Act still alive! Further welcome the plea for next hearing since it may help for a good admission policy in future." She added: "Schools may go for a fee hike this session. So Delhi government taking cue from states including Tamil Nadu and Rajasthan, should work on to enact the Fee Regulation Act."
Private and unaided schools moved Supreme Court on Wednesday in order to get a stay on nursery admission guidelines issued by Lt Governor Najeeb Jung denying them 20 per cent management quota and other criteria for admission to nursery schools. "Autonomy of these private school should be completely snatched as they are behaving like hooligans to the parents. This is clear from the stand that they have a big buck every year which has been snatched," added Abhishek Sharma, a parent.

At least for this year no changes should be made.....

It is rather unfortunate that the whole system of 'Education' has become a big 'business' these days !  Given the grave situation, the Government must intervene and command with an iron arm to prevent misuse of the reckless authority and power that the schools command over hapless parents.

Education being a fundamental right of every child, stringent regulations must be put in place, at once, so that this 'basic need' does not turn out into a luxury commodity to be enjoyed by a privileged few !

what will happen if based on first list, parent submit a fee to a school and a second list by a second school(better option) shows the name of our child. So if we want to get our child admitted to the second school, will the first school refund the admission/tution fee that we have submitted.

DOE has issued latest notification that school shall start conducting admission (acceptance of fee etc.) only after 28/02/2014.

that is true but suppose we deposit fee on 28th at a certain school A and if we get a better option in school B in the second list to be released on 15th March. Will school A refund the deposited fee in case we want to admit the child in school B? Is there any guideline on the same?

The entire fee except registration fee I charges shall be refunded.

49.How much amount shall be refunded to the parent / guardian of a child, if

admission is withdrawn by the par-ent / quardan within one month from the

date of admission?

If the child is withdrawn within one month from the date of

admission, the school may retain the Registration Fee / Charges,

Admission Fee and Tuition Fee for one month only and shall refund

the entire amount of fees or other charges within 15 days of the

request under proper receipt.

Sanskriti school chanakyapuri, Bal bharti school ganga ram, DPS vasant kunj and Amity international school saket; these school nursery admission on line registration form is not accepting age if child in born in 2009 ie they are accepting only child between age 3 to 4 yrs. Can anyone help me? Mr sumit vohra kindly help.

Mr.Vohra has highlighted this issue almost in all medias and file complaints against the school in DOE 's nursery helpline no. too.
