New Delhi: The Delhi High Court Tuesday sought responses from the Centre, city government and Sanskriti school on a plea challenging an order of Lt Governor that allowed the institution to reserve seats for children of bureaucrats.
Justice Manmohan also issued notice to LG Najeeb Jung and sought his response as to why an exception to the nursery admission rules for the school has been allowed.
The school, situated at Chanakyapuri here, has allegedly reserved 60 per cent seats for the wards of persons belonging to government services, especially the All India Services.
The court, however, refused to stay the admission process of the school saying, "It can't be stalled as you have come at the eleventh hour."
"I can't stay it. I did not allow the plea of private schools against the admission guidelines as the order was upheld by the division bench as well," Justice Manmohan said.
The order came on the plea of a three-year-old girl's lawyer father, Dheeraj Kumar Singh, who contended that the Lt Governor's Recognized Schools (Admission Procedure for Pre-primary Class) Order 2013 "permits specific government services and more particularly All India Services an unfettered and unrestricted right to reserve seats for their wards".
The plea alleged that the Lt Governor's order "has been necessitated to provide legal sanctity to admission procedure adopted by schools like Sanskriti".
Sumeet Pushkarna, appearing for the Centre, argued that since many such schools would be affected if the LG's order is quashed hence, other schools be also made parties.
He said a similar issue is pending before a larger bench.
Meanwhile, in another nursery admission related case, Justice Rajiv Shakdher today directed a private school to admit a child who was earlier denied admission on criterion of distance.
The court said the child, who was wrongly awarded 27 points, be given nine extra points which includes three each on the criterion of distance, cultural integrity and his parents' association with an NGO.

Sri Aurobindo Marg, New Delhi. While applying online, there is no option for uploading rent agreement. When I asked school authorities on phone, they said rent agreement will not work as per DOE guidelines. I have rent agreement as only proof of my residence in delhi.
Please suggest what to do.

@Vikas: I think schools are at liberty to list the documents as per their choice, however documents like passport/voter ID/Aadhar Card/Elect /Water/Landline MTNL bill cannot be rejected. These present guidelines have given a chance to reject rent agreement because of 70 pts to distance criteria. Anyone can make rent agreement and even can get it registered too. This may be the reason for not allowing uploading of rent deed
If it is a registered rent agreement than they cant say no. Ask them to give the reason for not accepting the form...
As regards age, RTE says it is for the children who are below 6 years of age, which is self understood. But confusion is again, once there is no upper age limit, how can school deny forms or granting admission to a child who is even 15 years old.
This is not logic. Upper age limit must be mentioned like born between 1.4.2009 to 31.3.2011.
Things should be standardized like ISO ideology. This year it is more confusing and choatic.
The logic of reservation is only and only "for upliftment of that strata of society" be it minority community or girl child or SC/ST/OBC.
One can understand reservation for the children of Armed forces who are doing real selfless service for the country.
But, Civil Services' people who are already the elitist of elite layer of society certainly do not deserve any reservation as according to me they are just doing a job for which they are getting paid and rather handsomely and with that enjoying power, perks, club memberships etc.
They are certainly not sacrificing anything for the country professionally.
Yash, I agree with you. But again this elite class has much more in their hands as they are the policy makers and competent enough to suppress even ministers to favour them. This is ironic. They may come up with the point we have worked hard and selected amongst lakhs. We are real activists because we contribute maximum in upliftment, without our support policies even cannot be charted out.
We have given the best values to our children and they equally deserve for what is essential to be a good citizen and real contributor to the society. And many more ... etc. etc. Anyway, reservation is creating chaos now a days.
I agree absolutely a relevant point...
