String of nursery admission orders puzzles parents

NEW DELHI: The numerous orders and notifications being issued regarding the nursery admissions every other day has left parents confused. No one is sure what the status is at present, which court - the high court or the Supreme Court - will finally decide what happens to the admissions this year and when their tots will start school. Some schools starting classes on April 15 hasn't helped matters.

Parents have begun consulting their own lawyer acquaintances for clarity. "A client of mine is an SC lawyer. I had a talk with him on the current situation. What he told me about SC dates is very alarming. He told me that in SC, dates are given many months away in normal cases and if the SC thinks the case is very sensitive and time-bound, and needs an immediate judgment, the best they can do in these cases is give dates 20 days away," says a parent. Another parent adds that it seems unlikely - factoring the schools' summer vacations and the courts' dates, along with general delays - that the process will begin before September.

There is also worry over the fees that many paid during the few days admissions were permitted by the high court. That round closed on April 9 and the April 3 order allowing admissions has been stayed by Supreme Court. "One court told us to decide and deposit fees within a few days and another has stayed that process. We had secured the seat for our child by paying a handsome amount," says another.

Some parents gathering on admissionsnursery.com are even considering appealing to the petitioners and asking them to withdraw the case.

He adds that several minority schools - and even the odd non-minority one - beginning session on April 15, has confused parents further. The starting of session on April 15 wasn't a high court direction but that of Directorate of Education.

 Rashtrya Saharaराकेश नाथ/एसएनबी नई दिल्ली। राजधानी के पब्लिक स्कूलों में नर्सरी की पढ़ाई शुरू नहीं हो सकती है। सुप्रीम कोर्ट में दाखिले को लेकर लगाए स्टे के बाद सेशन शुरू करने को लेकर भी रोक लग गई है। शिक्षा निदेशालय के निदेशक पदमिनींिसंघला ने कहा कि स्कूल फिलहाल सेशन शुरू नहीं कर सकते हैं। पहले जो आर्डर निदेशालय की ओर से निकाला गया था, वह 4 अप्रैल का था लेकिन 15 अप्रैल को सुप्रीम कोर्ट द्वारा दाखिले पर लगाए गए स्टे के बाद पहले वाले ऑर्डर पर भी रोक लगती हुई दिख रही है। यदि किसी स्कूल ने सेशन शुरू कर दिया है, तो उन्हें यह नर्सरी का सेशन रोकना होगा। बता दें कि हाईकोर्ट में बुधवार को सुनवाई के बाद अपनी सुनवाई 7 मई तक टाल दी है। एडमिशन नर्सरी डॉटकॉम के प्रमुख सुमित वोहरा ने कहा कि कोर्ट ने सुप्रीम कोर्ट के फैसले के आने तक की बात कहते हुए सुनवाई टाल दी है। उन्होंने कहा कि स्कूलों में नर्सरी की क्लासेज न शुरू होने से अभिभावक भी परेशान हैं। उनका कहना है कि उन्होंने तीन महीने की फीस दे दी है और स्कूलों में पढ़ाई नहीं हो रही तो उनकी दी हुई फीस क्या रिफंड नहीं होनी चाहिए। शिक्षा निदेशक पदमिनी सिंघला ने बताया कि स्कूलों में सेशन को लेकर फिलहाल रोक की स्थिति है, स्कूल नर्सरी का सेशन शुरू नहीं कर सकते हैं। साथ ही उन्होंने यह भी कहा कि फिलहाल सुप्रीम कोर्ट के आदेश को लेकर लीगल एडवाइस ली जाएगी कि नर्सरी का सेशन शुरू किया जा सकता है या नहीं और इस बाबत एक स्पष्टीकरण जारी किया जाएगा। पीतमपुरा वसुधा एन्कलेव स्थित एमएम पब्लिक स्कूल की प्रधानाचार्य रुमा पाठक ने कहा कि सेशन शुरू करने को लेकर भ्रम की स्थिति बनी हुई है, इस कारण स्कूल ने नर्सरी का सेशन शुरू नहीं किया। उन्होंने कहा कि इस भ्रम की स्थिति को देखते हुए निदेशालय को जल्द ही एक स्पष्टीकरण जारी करना चाहिए जिससे स्कूल व अभिभावकों को राहत मिले। रोहिणी स्थित माउंट आबू पब्लिक स्कूल की प्रधानाचार्य डॉ ज्योति अरोड़ा ने कहा कि बुधवार को फोरम ऑफ पब्लिक स्कूलों की एक बैठक हुई, जिसमें इसी बात को लेकर र्चचा शुरू की गई। डॉ अरोड़ा ने कहा कि यदि निदेशालय का स्पष्टीकरण आ जाए तो सोमवार तक स्कूल में नर्सरी का सेशन शुरू करने का विचार कर रहे हैं।

Everyone is speaking to start the session or refund the paid fee. One drawback of starting the session is : Children admitted after SC verdict, will certainly be looser in terms of studies. Regarding refund, schools are not at fault. It is the HC who permitted them to admit students. Now if this is taken up, again something may come against parents. Ultimately everyone is affected. Hence, let SC should make it very clear that "No more PIL will be considered on this year's Nursery Admissions". At times, we need to sacrifice many things. I think that time has come to respect SC verdict and support the process to end up.

Maharam Jee I think HC only lifted the stay from admission process. It nowhere said that session should start from 15th April. 2014. It is the DOE circular which mentioned that session would start from 15th April 2014, without clarifying as to whether session shall start piece meal or session will start only for those schools (like DPS RKP) where admission process is complete(no more draws) and all setas are filled. It would be only prudent for DOE to seek clrification from SC regarding its order and start of  session.  

Do not understand why classes should not be started. Schools have rooms allocated to Nursery .. they can NOT use it for any other purpose. Schools have teachers appointed for Nursery who would have no option but to come to school and do nothing or useless activities they will not love and from a school's perspective they are getting paid for April till whatever month our SC/HC come to a conclusion that sessions for this academic year can start and all parents STOP filing further PILs . Children are admitted , parents perspective they have already paid fees. I believe school should start session for children already admitted. and for children who join their class mates later things start again where already admitted children revise whatever was done. Nursery as such does same things 2-3 times an year. I am sure for all those whose admission is not confirmed would be in a good play school , if not, parents need to put then at least for first quarter ; no point in all children waiting for we foolish and selfish parents and useless courts.. 

The schools should start their classes in which the admission process is over ....And in other schools where admission is partially done ,they should also be allowed to start the session....and the rest which will join later should be put together in a different section ...Kids have already learnt their nursery syllabus in their play schools..lagging behind a months does not make a huge difference..At least the parents of already admitted kids will get some mental peace...

Do you have any idea when the DoE notification after taking legal advice (as informed by Moderators) would be released as I feel that the same will clear whether schools can start or not 

Suman i dont know when will taht happen but if DOE takes legal opinion on its own it will again cause huge confusion/chaos. It should only approach SC for opinion on start of session. But as per me as IST applicants have approached SC for restoration of tfr points then without decision on that issue it would not be prudent to start session. What if tmw SC restores tfr points then all alumni admissions will be invalid.   

PATIENCE IS THE KEY.

 

All alumni admissions would NOt be invalid. There are schools which had clear admissions for 75 pointers and 70 point draw was done for handful of them. Also, in other schools like DPS, there are two sets of alumni: First who got admitted by first draw that included transfer cases. Second, who got admitted directly as left alumni was lesser than vacated seats or got admission in second draw of 75 pointers consisting of ONLY left over Alumni. It is ONLy the second set described above whose admission will be invalid. admission would be safe for alumnis in schools where 70 point draw happened and first second of alumni ( as described above) in other schools.

So if SC retains that points remain scrapped, in my opinion, HC order for first 70 point draw to remain valid would be applicable; this would create room for a second PIL by this non-delitie groups (TFS) to challenge HC order for redraw of all 70 pointers including them. There is additional room for people who lost PIL in HC for fighting against alumni and sibling points , so there is good room for new PILs, new dates and new frustrations but no room for hope and justice to all innocent kids. So Parents , all the best 2 all including me, May all our soul rest in Peace !

I think 4 months is enough for patience. We are patient from January, patiently seeing all this from January, finally when the child admitted in a school, all formalities done, SC stayed the process again. People are now telling that partial classes can not be started. But I want to ask, when DOE (before SC order) instructed to start the session from April 15th, then nobody objected on partial classes. Even now if from 22nd April session will start, then you can see that there are only 25 days (10 of April and 15 of May) when classes can be take place. So, in my opinion, there will not be any harm to remaining students who will be admitted in July (if that happens) because after all its just nursery. 

Because sending a child again to playschool is for 25 days by paying again fee is not a good idea as playschool will also charge full fee.

completely agree with sachin ji, 

 SC stayed the HC order of 3/4/2014 which made all selected 70 pointer as valid.. so if stay on selection of seats(i.e in HC order ) is there.. how can school start session with these selected children(on which stay has been put by SC) ?? 

I feel it wud be unfair to start school for kids who hv got admission, all kids shud start at the same time, my child has got a seat (although not my preference) but I am willing to wait till all the kids get admission and the session starts, I hv also paid for both play skl and main skl, after all kids r going to the play skl...as far as the payment made to main skl is concerned lets wait and c but most imp now is that every child shud get admission and SC takes a fair decision and everything ends in a pleasant way...its a very stressful situation for the parents who do not hv a seat and clarity what is in store for their kids...
