Attorney General Mukul Rohatgi on Thursday suggested before the Supreme Court that the reservation in the prestigious Sanskriti School can be extended to cover children of lower category government employees too, rather than preserving it exclusively for wards of Group-A officers.
“The Union of India had already filed an affidavit in the Delhi High Court in which we said the School has been advised to grant reservation in admissions to the wards of Group B and C employees as well,” Attorney General Mukul Rohatgi, appearing for the government, told a Bench led by Justice Anil R. Dave.
Sixty per cent seats in Sanskriti School are reserved for children of Group-A officers, 25 per cent for those from the economically weaker sections, 5 per cent for its own staff and 10 per cent for the rest of the society.
The Delhi High Court had, in November, set aside the 60 per cent quota for children of Group-A officials. It compared the policy to the “erstwhile segregation of white and black students in the U.S.” and said it violated constitutional provisions of equality and right to education.
Both the government and the school administration had sought an interim order so that the litigation in the Supreme Court would not thwart admissions. They said the nursery admission process under the local laws began on January 1 and the school was already behind schedule.
Senior advocate Kapil Sibal, who is amicus curiae, advised a balanced approach, with an eye on the fact that the school ensured quality education for the children of officers who are often transferred or sent on foreign assignments.
The Bench has fixed the case for interim order on January 11.
Manish Sisodia, who also holds education portfolio, said that the schools can make admissions as per their own "reasonable criteria system", but there should be transparency and fairness in the process.
