NEW DELHI: The Delhi high court on Wednesday gave the Delhi government three months to decide on a plea seeking an amendment in the admission procedure for nursery classes to bring it in line with the Right to Education (RTE) Act, which prohibits screening of children for admissions.

A bench of Chief Justice NV Ramana and justice Manmohan disposed of a PIL while directing the government and the Lieutenant Governor (LG) to take a decision on the representation by Social Jurist, a civil rights group. According to the PIL, the Delhi government had, in its 2007 order, given freedom to private unaided recognised schools to frame their own guidelines for nursery admissions.

Ashok Agarwal, the petitioner’s counsel, argued that by giving a free hand to private schools to formulate their guidelines, the government had violated Section 13 of the RTE Act.

The lawyer argued that the high court in its February 19, 2013, judgment on another petition had said “though we have held that the RTE Act is not applicable to nursery schools, in our opinion there cannot be any different yardstick to be adopted for education to children up to the age of 14 years irrespective of the fact that it applies to only elementary education”.

The lawyer said the court had stated that the petitioner was asked to give a representation to the LG for making appropriate amendment in the government order granting autonomy to unaided schools to frame guidelines.

Government should consider necessary amendments to the Right to Education Act to include nursery admissions. DOE should take steps to apply RTE Act in admission procedure of nursery admission at the earliest and not ahead of admission schedule and avoid all confusions regarding the same at the earliest.

 

Lathaaji I agree and they should disclose the criteria well in advance and not at the eleventh hour like every year.

dont know why all such matters are brought up just before the admission process - deliberate or poor approach .

Hi everyone,

I too read this in column in today newspaper. Its actually a good effort to finalise the admission criteria & make the same applicable for all schools in Delhi. In my view this should now be followed religiously, by lawmakers, parents etc. just to ensure that this "Actually Happens" and just doesn't keep moving on papers.

Moreover the same criteria should be applicable all over india too so that even in case of transfer, parents are aware where & when to go & what's the admission procedure to be followed.

In my view, the best time to take this initiative is " At the Earliest" better late than never. This whole procedure should be finalised & law should be amended on "Top Prioty" by concerned authorities. But at the same time one should understand that all this is in interest of us only i.e. PARENTS and therefore we should all contribute in one or the other way to stand together & ensure that law is made otherwise if we leave on fate then who knows, next year also same situation will exist & parents would keep on running from one school to another from pillar to post.

I wish this admission procedure gets atleast somewhat better than earlier days.

Why not these regulations are there in Gurgaon? Why only for Delhi? I think Gurgaon has a more need of a regulatory body for the admissions.

Sorry to say but, this is just because none of has taken this matter seriously in Gurgaon till now. As a result all plush looking schools or I say Business units are enjoying the benefit.

Believe it or not, its the need of an hour that each one of us do a bit to ensure that the same process is being followed in every single school in NCR. I know, its not so easy but it not too difficult either.

Yes, you are right in saying that Gurgaon has much more need of these regulatory bodies.

Exactly. This is the reason that this matter should be discussed, highlighted & resolved for whole NCR & not only for Delhi or Gurgaon which in turn will happen only when Parents of all NCR will get together & act accordingly.

Rich:- Not bother :- afford any school(10%)

Hi Middle class:- Can afford (40%)

Middle class:- No time(40%), so cant fight

Low Middle Class:-Govt school for us(10%)
