Nursery admissions in Delhi will not begin on January 15 as some private schools on Monday moved the Delhi high court against the new guidelines, terming them illegal and arbitrary.
Some unaided private schools challenged a single-judge bench order that had on January 10 refused to stay the government notification setting down criteria for admissions.
The new norms were issued by lieutenant governor Najeeb Jung last month. Unaided private schools are those who do not get government grant.
The city has around 1.25 lakh nursery seats as against almost 1.50 lakh applicants. The top 50 schools get most applications even as seats remain vacant in the remaining 1,000 schools.
While it refused to stay the new guidelines, a division bench of justice Pradeep Nandrajog and justice Jayant Nath indicated that certain admission guidelines needed a "re-look".
“This (petition) needs detailed hearing. We are simply deferring the hearing without any order," the bench said. The Delhi government assured the court that it would not commence the admission process on January 15 and wait for its order.AS ADMISSIONS WONT START FROM 15JAN ,WILL DEPEND ON JUDGEMENT OF COURTS ON 15 JAN.

@Mahram Tanwar : Somehow your comments look like favouring actions of vested school managements.
Anyways, what Social Jurist is doing is absolutely correct, they are fighting the case in the court for change in admission system.
They have got the schools to change criteria from erstwhile 100% arbitrary criteria to somewhat acceptable (read mostly unacceptable) criteria till last year.
It is long drawn fight when it comes to court cases & it does not mean that if court does not gives favorable decision for current admission session, the schools are allowed to go scot free for eternity.
For delay only slow pace of court cases & school managements are to be blamed. Why did the schools waited for a month to file cases. They could have done it on 19-12-2013. They want the parents to be under pressure. Parents should understand that Nursery admissions are not Cancelled but only delayed, so what if Nursery seession starts a month late or heck 2,3,4,5,6 months late.
On the other hand WHY schools are so much adamant & WHY the schools are not transparent & WHAT is there to hide that they are fighting it tooth & nail. Why do you ask them not to go to the courts.
Children will get admission no matter what criteria is followed this year. It is not that there will be no nursery class admission this year, correct ?
Social jurist case was as good as over as soon as the LG issued guidelines on 18-12-2013.
Also point to be noted that LG had issued guidelines on direction of the court, so how can schools say LG does not have jurisdiction?
It is the schools which are creating ruckus by challanging LG's order & thus delaying admission process.
So let us wait & watch & give due credit to people out there who are fighting against malpractices, while we sit & blahblah on blogs from our cozy homes.
Dear Sansan, I am not favoring school lobby, but at the same time I also do not want any one sector to be suffered. As regards LG intervention, schools have filed their writ immediately after the guidelines issued. It is the court who gave its verdict that no relief from court for the schools and now again a bench of justice stayed the order of an h'ble justice. It means there is something vital aspect of welfare of the petitioner which needs time to take decision.
The basic purpose was to grant reservation to under-privileged society in admissions by the private unaided schools allotted land by the govt on concessional rates and this was in practice till the current session. Why every decision should favour parents only? Why this discrimination with schools? Why not equal justice to both parents and schools? You asked reservation, it was given, you asked no discrimination and screening at all. They why do you discriminate others over siblings and alumni or transfer cases or girl child. Why it was not taken into consideration while issuing guidelines. Do you think it is not discriminatory allotting points for girl child or siblings or transfer cases.
What is the fault of a 1st born male child? Do you have answer? Where all those children will go who do not get admission in any of the school irrespective of their neighbourhood criteria because of lottery system evolved by 70 points.
Reply now, suggest ideas if you have with you. Why schools should file writ before the guidelines? If anything is not favourable to anyone, will they be deprived off their fight for their rights?
And if social jurists have thought of public benefit, why they did not think for the schools who could think for writ against the orders which came true now.
Plz suggest better and just approach. I may be wrong in my words, sorry for that. But please give me an option for my earlier posts in which I requested for an admission of relative of the chairman/president of india who did not get admission in any of the school without management quota.

Mahesh, Nothing could be farther from the truth. I support the LG's guidelines and was very happy that management quota had been done away with and a uniform point system made applicable limiting the discretion of the schools. However, everything seems to be in jeopardy now.
I am too in 100% support of LG's guidlines they are just and balanced however they go against the monetry gains of private run schools

Question is not for whom I work. Idea is to get transparent and just system for all. Here we are favouring only for parent community means selfish approach. few of us asking distance limit to increase more than 10 kms.
Just Belind thinking. Favoring increase in distance won't lead too mcu draw of lots. Now you want admission with lottery. Again we parent will cry against lottery which is even more likely to be with 8 kms radius also. Just see the drama after 31 January.
I don't mind my criticism. Applying anything without proper analysis would lead to these type of problems. Therefore, it is better think all around holistically.
Why the case was not taken up immediately after last years admission process for the 2014-15? Now blaming schools for filing their writ very late and not blaming social jurists for the same. Why they did not bring the matter to the court well in advance. Wasted 6 years precisely
This proves common sense are not so common. This is harassment in the name of democracy and law of natural justice.
Exactly Mr.Dubey, the fight is not so easy. Battles are won these days not because of the largest army but because of tectics. We need to apply our common sense before taking any step whether it will be just for all or a few one. Think large.
mr. sansan, you are denied for credit cards which proves your credibility. Once you don't have your credibility, how can you question others to be guilty and favoring one factor only. Plz come back on the forum we parents need your help. who know you might come up with a good idea to help everyone. Always believe in yourself and the supreme soul.
