No nursery admissions in private Delhi schools till final verdict, orders court

Delhi: The Delhi High Court on Monday ordered private schools in Delhi to not allow nursery admissions till it gives a final verdict on the validity of government's 2010 notification and whether it follows the Right to Education Act. "Schools cannot formulate their own admission policies," the court further ordered.

The notification allows schools in Delhi to formulate their own guidelines and preferences based on religion, sibling and alumni to admit children in nursery. The court had earlier said the Centre and the Delhi government cannot "dilute" RTE Act by allowing unaided private schools to use their own criteria for nursery admissions.

The court had also said the ongoing nursery admission process in Delhi would be cancelled if it decides to "quash" the notification issued on December 15, 2010 by the Directorate of Education (DoE) on behalf of Delhi government.

Today the matter is listed at the bottom of the list in High Court and there are very few chances of its being heard today.

We want equal opportunity when applying to schools of our choice. Which means an equal chance of getting into the school. If you and I are competing for a single seat, I don't want you to have an unfair advantage. 

Equal opportunity does not mean equal achievement or result or satisfaction. No body is saying that we should all get what we want. But we should have equal opportunity to get what we want. Right now, so many parents are disappointed because they do not have sibling points, transferable job points, alumni points. So they don't even have the opportunity, the chance either.

Give everyone an equal chance. Let the suffering be equal. 

Why cant they upgrade the quality of government schools so that people have one nearby and it will also downgrade the high headedness of unaided private school?

I am 100% sure nothing will happen to current point system. They would keep on hearing for few days and then would say they dont want to play with kids future so lets continue with current system. Meanwhile negociations are going on between person who filed PIL, court and school to settle the dispute in favor of current point system as this helps schools to do discrimination and then take donations. Had they been really serious about this issue they would not have wasted a year to file this PIL.

So keep watching the drama and how they make our fools

Since it is a PIL... even if the person who has filed it, backs out... the court can continue hearing the case if it relates to government failing in its obligation to deliver on the rights promised to people under the constitution... which the court feels is the case.

I hope they define exactly how the RTE is to be implemented... till that is defined, there can be no long term solution and people will keep walking in and out of the court with their own versions. Secondly once it is defined, the verdict cannot be limited to Delhi, then the central government will have to implement the same throughout India which cannot be done in a day, probably not even in an year... 

So the hearing would continue and in absence of any quick fixes we will have to continue with current system.

Does anybody know who is mr agrawal who filed the PIL? And why he has done so, in what interest?
i think that is exactly what is going to happen , STATUS QUO, just unnecessary anxiety and chaos at this juncture.

My sense is that a lucky draw kind of an admission process can only work in conditions when there are defined schools for every neighbourhood or a cluster of neighbourhoods and when each of the schools has the same fees structure, infrastructure, student-teacher ratio, transportation provision etc. 

This is only possible under a government controlled or central system of educations where the government has invested in education infrastructure up to required standards... which is a long way to go... but atleast the government can start on it and prepare a road map for the same taking cue from the high court ruling.

Let me correct you Ms. Stuti. I stay 100 m from a school. I do not stay 100 m from a 'good' school. It hurts me dearly to see that my name is not listed even in that school. In all schools, irrespective of whether they are good or bad, the unfair criteria provides advantage to a select few. The remaining have to either shell out hefty donations or run to NCR where the criteria is even more obscure. 

Let me explain again. If there are 100 seats in a school. Some number of those should be reserved for neighbourhood children and those seats should be allocated using a draw of lots. Which means that not all kids from the neighbourhood would be lucky. The remaining or at least equal number of seats should be opened for kids from farther distances and once again allocated using draw of lots. No one should have an unfair advantage and everyone should have an equal opportunity to get into the school which simply means an equal chance of success as well as an equal chance of failure. That's what we want.

Same here... i also want to get rid of existing base less point system...

according to me, all the criteria like alumni, transfer case, single parent etc. should be scrapped, about sibling it has to be scrapped or weightage to be reduced or there may be few seat reserved for sibling category (though mine is not a sibling case), there may be draw of lot for those seats among them, so that other kids also get chance...

Now about point system for the schools there have to have some criteria...thats why i opted for neighbourhood... though none of the good school is near by my house...

Earlier there were points on parents education, which has already been scrapped, so we can't expect the same to be implemented...

May be even if the point system gets revised...our kid may still be left out... still the discriminatory point criteria is really sad to deal with.... atleast we will be happy for the reason that there is no discrimination....

who ever has filed the PIL, irrespective of the reason, why he has done so...thanks a lot on our behalf...

I completely disagree with the neighborhood criteria, to my mind having a lucky draw to decide where your child studies for 12 yrs is an absurd option. Am again repeating what I said earlier, in the current system at least 60% children get a school of their choice, 40% do not. Instead of creating a system where most children get a school of their choice we cannot move on the logic that let us create a system where most children may not get a school of their choice but it gives equal opportunity to all so is therefore a good system.

If we are to move to a random criteria like draw of lots then I would have say let's have no criteria at all, not even neighborhood. I say this even though I am in a neighborhood with 4 or 5 good schools.

Going by this equal opportunity logic I think we should then start applying this to many other areas like jobs, granting admission to patients in hospitals, water and electricity supply etc. In Delhi many areas get lesser electricity then some other areas. Should the authorities draw lots each day to give equal opportunity to each area. If I go for treatment for a life threatening disease to a govt hospital having limited beds, then do we have draw of lots to decide whether to admit and treat me or leave me to die. If I as a business have to hire 10 skilled workers in Delhi and 100 apply all of then suitable for the job, can the govt bring in a law that I cannot de die whom to hire and that I draw lots??
