No nursery admissions in private Delhi schools till final verdict, orders court

Delhi: The Delhi High Court on Monday ordered private schools in Delhi to not allow nursery admissions till it gives a final verdict on the validity of government's 2010 notification and whether it follows the Right to Education Act. "Schools cannot formulate their own admission policies," the court further ordered.

The notification allows schools in Delhi to formulate their own guidelines and preferences based on religion, sibling and alumni to admit children in nursery. The court had earlier said the Centre and the Delhi government cannot "dilute" RTE Act by allowing unaided private schools to use their own criteria for nursery admissions.

The court had also said the ongoing nursery admission process in Delhi would be cancelled if it decides to "quash" the notification issued on December 15, 2010 by the Directorate of Education (DoE) on behalf of Delhi government.

Great move; if something like this is done. Every body will be having equal right. Not by sibling or other wastefull parameters to decide school admision...

The Delhi high court on Monday made it clear that its decision on a PIL, challenging government notifications giving powers to unaided private schools to formulate their own criteria, would also affect nursery class admissions for the academic session 2013-14.
  "Our
order (on the PIL) would also be applicable on nursery admission for ensuing academic session 2013-14," a bench of Chief Justice D Murugesan and Justice V K Jain said.

The court's observation came during the hearing of the PIL, filed by NGO Social Jurist, against two notifications, issued by the human resources development ministry and the Directorate of Education of Delhi government.

The PIL alleged that these two notifications have "given a totally free hand to all unaided recognised private schools to formulate their own nursery admission criteria based on categorisation of children..."

However, the categorisations of kids by schools in admission have specifically been barred by the Right of Children to Free and Compulsory Education Act, it said, adding some schools give preferences in admission on grounds such as religion, alumni and sibling.

"You (DoE) cannot dilute the provision of the Right of Children to Free and Compulsory Education Act. You are giving preference to one child over another, which is against the Act, by allowing them (schools) to formulate their own admission criteria," the court said.

"We will have to test the notifications ... and how far such powers can be extended to schools (by the governments under the Act)... If you give liberty to the schools then the whole purpose of the Act would be lost," it said.

However, the counsel, appearing for an association of private unaided schools, said that schools be allowed to formulate reasonable admission criteria. The court would also hear the arguments on Tuesday on the PIL.

Earlier, the NGO's counsel Ashok Agarwal had said that he wanted the law to be settled on the issue and would not like the ongoing admission process for current academic session to be affected by the court order as all kids are alike and innocent.

"Whole ongoing nursery admission process would go if we decide to quash the notification issued on December 15, 2010 by the Directorate of Education (DoE) on behalf of Delhi government," the court had said.

The NGO alleged that the power given to schools to lay down admission criteria was "contrary to Section 13 of the Act which says that there would be no screening process of either parents or of kids and no child would be discriminated against. It also provided that admission would be taken by way of draw of lots and the neighbourhood would be only criteria."

Separate guidelines cannot be framed by schools, it said, adding that despite the law being "clear", the schools have been formulating their own guidelines and according preferences in admission processes on various discretionary grounds.

On November 23, 2010, the HRD ministry had issued guidelines under the RTE that had allowed the schools to frame their own admission criteria, the NGO alleged.

Later, DoE of Delhi government also issued the guidelines on similar lines, the PIL said.

Govt, schools and the whole system wants to maintain statuesque. i have noticed that every year in the month of Sep /  Oct, the nursery admission issue is being raised by some ngo and even by govt and all the parties involved( Schools association, NGO and govt) usually meet couple of times. I believe govt ( Edu Minister) en-cash this opportunity to get tons of hard cash from different school management and leave us in front of them to be exploited by their ridicules admission terms and condition.

Honestly, even I dont have 100% faith in sleeping judiciary and seems they also looking to get their part from this open loot. school owners are capable and definitely will hire the JUDGE itself instead of Lawyer to prove their point. i don't expect much from this verdict.           

Whatever it means for parent..............At max we have to take some days off again......but that is nothing if our child get fair chance in each and every school. even though my ward has got call from 1 school but even then i support this move by HC and hopefully verdict will be announced shortly

The whole drama will end in few days  when the schools ( Business Centers) will pass over the share of the donations to the Govt , the law makers and others. 

What difference will court verdict brings..... as everyone is running for branded schools not merely schools.
There are enough schools in the city but every parent wants the admission only in branded school in delhi . This race is the main reason for today scenario.......... which court ruling may not be able to change.

feel like children will now be kept at home since court will take there own time to resolve there matter or probably we can take our children to HC !!!! Its really sad such things coming at crunch times....lists are about to come and who is responsible to all the money and more importantly time that has been spent by parent in filling the forms running door to door of various schools.....

The court has reacted late but if it issues orders to ensure that the admission process becomes fair and transparent, it will be welcomed by one and all. Centralised admission under any independent organisation or Dept. of Education seems the only solution.

Lets assume that the admission process is  re-framed. But then again, children will be shortlisted by draw of lots. How honest the schools will be this time around is anybody's guess.

This lottery will be again a big question mark on the whole process. We all know how things happen in our country.   

At last some hope for aspirants!!
