Delhi: The Delhi High Court on Monday ordered private schools in Delhi to not allow nursery admissions till it gives a final verdict on the validity of government's 2010 notification and whether it follows the Right to Education Act. "Schools cannot formulate their own admission policies," the court further ordered.
The notification allows schools in Delhi to formulate their own guidelines and preferences based on religion, sibling and alumni to admit children in nursery. The court had earlier said the Centre and the Delhi government cannot "dilute" RTE Act by allowing unaided private schools to use their own criteria for nursery admissions.
The court had also said the ongoing nursery admission process in Delhi would be cancelled if it decides to "quash" the notification issued on December 15, 2010 by the Directorate of Education (DoE) on behalf of Delhi government.

It looks like a big nuisance. We as parents are all ok with any guidelines as long as they are in favor of our children, BUT imagine, such confusions arising at a moment when the admissions are about to happen.
Imagine a lottery system, wherein, there would be no guarantee of any admission again. What NEXT?? Will this confirm the RTE Act?? I am in complete favor of siblings being admitted to the same school which is a BIG PRACTICAL advantage for any parent. I am not sure why do we keep going back and beat the dead horse.
I totally agree with Mr. Aashish.How can court ensure that lottery system will be fair and not be manipulated ? I am also in favour of siblings being admitted to same school as it is of great practical use. I also wonder what happens to the management quota seats in case court decides school cannot decide their own criteria. RTE act was implemented without any thought to its practical implementation and now courts/media/government all are having their fun at the expense of hapless parents. Strangely It is OK to have caste reservations in IIT,IIM & IAS but great injustice if something is done for sibling/alumni in private schools. Government and courts should stop being hypocrites and keep out of this matter OR do away with all reservation everywhere.
Why is it OK to exclude Minority schools from implementing EWS quota?
Why is it OK to admit a less scorer based on Caste?
Why is it OK to discriminate in Govt. jobs based on Caste?
Why is it OK to include a high earning parent in EWS based on Caste?
Why is it OK that our govt. has failed to improve condition of its schools?
Then
Why is it not OK that kids closer to schools be given more preference?
Why is it not OK that siblings be given preference?
Why is it not OK that First born be given equal opportunity?
Why is it not OK that Girl child be given preference?
First court should answer these questions.
Insted of giving random judgements like draw of lots which would create chaos, court should frame an ideal point system which give preference to much required practical aspects (Distance. Sibling, etc) and do away with discriminatory criterias (Alumni, Award winning parents, Parents profession, income, Religion, Caste, etc.)
Court should also consider that EWS quota is also categorisation / discrimination between children based on Parents' income (Below and above set level), Caste (General and SC,ST, OBC), and Parent profile (Orphans).
Will the judgement be effective on that too?

Good questions. But I am not in favor of siblings again. The only criteria should be distance. As this is the only criteria that affects a child physically.
If there are 100 seats in a school, 50 should be allocated by draw of lots to neighbouring children. Remaining 50 should be open for children in the 5-10 km distance range. No child should be sent to a school which is more than 10 km in distance.
There should be no management quota so that more seats are available for draw of lots. If they cannot do away with management quota, it should not be more than 10% of the total seats. So that schools can sell these seats to very rich people who have to pay through their nose to secure a good school.
I do agree atleast sibling should get the admission in the same school , This is very practical .
Practical for who? For the parent with sibling points? Is it practical for parents who have a single child?
Sitting in your comfort zone, not worrying about thousands of other parents who equally deserve to admit their child to a decent school but fail to do so because of this unfair points system.
Distance should be the only criteria. Because it directly affects the child. Siblings points, transferable jobs, single parent, these criteria don't affect the child physically.
Everybody should be provided equal opportunity. If the opportunity is equal, at least the parents wont feel ashamed of not being able to admit their child to a good school because they wont be alone.
Also, if there is no guarantee for anybody to get into branded schools, eventually no body would care about brands. People wont care if their school is not branded as they would know nothing guarantees admission in a branded school.
Yes, there should be no guarantee for admission for anybody. The problem with the current points system is that it guarantees admission to some people only and not all. People with no sibling points and transferable job points do not even stand a chance. They don't even qualify for the lottery. Without the unfair criteria like transferable jobs and siblings and single parents etc, everybody would stand an EQUAL chance.
Distance matters. It's the only thing that should matter. Distance is the golden criteria all over the world.
Will the Delhi HC judgement applicable to all schools in India? No
Will it be challenged in Supreme Court? Yes
So why is there so much fuss about the judgement? It will take another 3-4 years for Supreme Court verdict to come.
