The Delhi Government, finally responding to complaints by parents harassed by private school managements that have been blatantly violating nursery admission guidelines, has warned schools to fall in line or risk ‘strict action’.
The Directorate of Education (DOE) issued a seven-point circular on Saturday (January 12) warning schools against having unreasonable and discriminatory admission criteria as such educational background of parents, arbitrarily fixing upper-age limits, denying admission forms to children from the economically weaker sections (EWS) on the basis of neighbourhood criterion, forcing parents to buy the prospectus of the school, holding parallel admission processes for the primary and pre-schools sections and violating the directive on minimum seats at the entry level. But with the circular coming barely two working days before the last of date submission of applications (15 January), the clamour for an extension of the last date is growing.
Not surprisingly, two days after the circular was issued, there has been no impact on the schools. Parents are complaining that schools are continuing to force them to buy the prospectus and that upper-age limits and unreasonable admission criteria are still being insisted on.
“Parents were happy on Monday morning in the hope that the circular will have an impact. But erring schools have not accepted the mandate of the DOE. The school lobby is very strong. No school has done anything concrete. Not even a single school has removed the admission criteria that is in violation of the guidelines,” says Sumit Vohra, founder admissionsnursery.com.
The point-system based admission process (where admission is based on points allotted to criteria chosen by schools) has been challenged as being in violation of the RTE Act and has been criticized by parents as being discriminatory and arbitrary. (Read full report here)
Arguing for action against erring schools, Vohra says, “Stringent action should be taken against schools who are flouting the guidelines. Unless and until at least one school is de-recognised, no school will make amends.”
According to Vohra, the number of schools flouting RTE guidelines has risen from 10-12 last year to 50 schools this year.
“Our first and foremost demand is for an extension of the last date. The last date has to be extended, otherwise, there will be no point to this circular. The schools will require at least 2-3 days to re-vamp their point-system. And parents should be given another 5-10 days to complete their applications process. And extension alone is not enough. Schools should be forced to implement the circular,” said Vohra.It is the first time since 2007, say activists, that the DOE has issued such a circular warning private schools.
Khagesh Jha, Delhi High Court advocate and a Right to Education activist, said “The circular is a big achievement for parents. But circular by the DOE alone is not sufficient, the government should take strict action against erring schools.”
The impact of the directive on the number of seats at entry level, says Jha, will add to the number of seats by over 50, 000.
“Parents should be given time to apply. To accommodate the additional applications, the last date will have to be extended,” he said.
While EWS applicants are seeing some superficial improvements in the process, worries about how far their applications will make it in the admissions process remain.
“While applications are with the schools, the apprehension is that they remain outside the admission process,” says Thomas Antony of JOSH, a voluntary group that is running an RTE project in a re-settlement colony in an East Delhi neighbourhood.
Parent applying in the EWS category are also seeking more time for applying to schools.
“Even though the DOE clearly states application forms should be available during all working hours of schools, many schools are issuing forms only for an hour. It was only after reports in the media and pressure from the government, the common forms (for EWS applicants) have been uploaded on-line. If parents are given another 15 days, it will be very good,” Anthony said.

Sakshi, i've already lodged the compalint and while checking the status, it reflects the msg 'Compliant under process'. Just to increase the size of the complaint box is not sufficient, some serious action should definitley be taken. Schools like DPS and Balbharti (dwarka) don't even answer the phone calls and have to abruptly say 'we are following our norms'.... do you think statements like this really reflect good?
We still are confued whether the last date extension has been implement and whether schools are strictly following it.
I still can't see DPS ammending thier age criteria and extending the last date.
Yes Priyanka , we have observed most of the complaint shows "Compliant under process'.some manipulations going on ?
but who are the ultimate sufferers in all these manipulations?????
I appreciate efforts made by your team but DOE should now strictly come witha fixed guideline in-extending last date for form submission and extending the upper age cap. By leaving onto the schools, tehy are following their own criteria and upon our enquiry they only have to say 'it is DOE implemented guideline'.

is there no action against schools who openly ask for money to book seats even bfore announcement of first list.
“Section 13 (1) No school or person shall, while admitting a child, collect any capitation fee and subject the child or his or her parents or guardian to any screening procedure.
(2) Any school or person, if in contravention of the provision of subsection (1)(a) receives capitation fee, shall be punishable with fine which may extend to ten times the capitation fee charged;
(b) subjects a child to screening procedure, shall be punishable with fine which may extend to twenty-five thousand rupees for the first contravention and fifty thousand rupees for each subsequent contraventions.”
I agree with this. In fact, the school like New Era Public School, Rajouri Garden and Naraina Vihar, Bal Bharti, Pusa Road and Faith Academy, Prasad Nagar, simply denied to extend the age limit or help otherwise. Bal Bharti Pusa Road has an online form that allows you to enter age from 2009 and upon calling them to find out they simply have one statement that they are following the DOE Guidelines and as per the guideline the child born between 01.04.2009 to 30.03.2010 can only apply for nursery and the child born before that in the year 2008 should be in KG and banged the phone giving the reason that we have other things to handle as well. Upon asking, how will the child cope up the whole one year nursery syllabus, their answer was that teachers revise the nursery syllabus for 1 1/2 months and then they start their KG curriculum.
Because of all this chaos, I was only able to fill up 4-5 forms around my area because of the age criterian and don't know whether my kid will be able to get admission in any of the school that I submitted his application.
I must appreciate all your efforts but it will only be a success when parents be given an extension of the last date and strict actions against erring schools should be taken else, parents will suffer like this every year.
I agree with you Ms Veena. It's only if DOE comes with fixed guideline and shouldn't be left on the schools. If DOE woudl have issued some statement last year, atleast we as parents woudl have been prepared and applied accordingly.

and now from MAN it is coming to the children..
Why dont' the goverment authorities understand their own guidelines and then pass it to the schools as the schools have their own monopoly. I heard good things about the schools I mentioned and dealing with them left a negative impression. If the school authorities are so disrespectful of the rules, what they will be teaching to the kids, is quite understandable.

Mr.Vohra has well said about derecognisation of Schools if they are are not able to follow the DOE orders. DOE administrators have all powers to regularize the education system. DOE Director should not hesitate to derecognise any private school if found that government directives are not followed. There is provision in the Right to Education Act even to prosecute the violators for criminal offence. DOE should use all its powers and force the schools to implement the latest revised admission guidelines. Extension of admission process is essential for suffering parents.
