HC reserves verdict on nursery admission row
New Delhi, Jan 18, 2012, (PTI):

The private schools on Wednesday told the Delhi High Court that the Right to Education Act allows schools to admit children below four years in age to pre-school (nursery) classes which is part of the formal education system.

Appearing for the schools before a division bench of acting chief justice A K Sikri and justice Rajiv Sahai Endlaw, counsel Sobha said that as per the Act, nursery classes could be treated as entry level the pre-schools should not be segregated from the formal education system.

The court was hearing a petition filed by Social Jurists, a non-government organisation, challenging the government’s December 16, 2012, order allowing schools to admit children in nursery classes at the age of three instead of four which was allegedly violative of the Delhi Education Act.

Sobha countered the petitioner's contentions that pre-schools should not be treated as entry point and it should not act as feeder for pre-primary schools. The bench reserved its verdict after hearing arguments of the petitioner NGO, the Delhi government and city's private schools on the PIL.

Now what the hell does "Reserved its verdict mean"? Does it mean .. We don't know what to say .. or does it mean .. go on the way you are .. what are we supposed to make out of this????

Dear Anand

As after months of argument between social jurist/ govt counsel/ private school counsel ..The judges will study 100 of pages of ganguly report/ rte etc and they require atleast 4-5 days to reach to any conclusion .

So as per feedback the verdict should come early next week ( not sure might take more days) !!

So .. for the past month+, the Hon. Judges were only "listening" to arguments. They had not studied Ganguly report or RTE or any other documents pertaining to the case??? They'll do all that in the next 4-5 working days, with all the other cases they would be hearing? Wow! Speechless ..

You are such a learned guy ..must try to understand ..they are not just listening to NURSERY ADMISSIONS ..they have thousands of cases pending far more imp than this.

So it was even learning curve for all our counsel also RTE vs Ganguly..i don't object them taking 3-4 days BUT YES THE MATTER SHOULD HAVE BEEN RESOLVED IN DEC ..I CONCUR WITH YOU !!

Sumit .. my concern is ONLY with respect to parent's of the on-going session. If the outcome is not going to affect the current session .. they can take up the whole year to study in depth. However, bearing in mind the criticality and the fact that there's already been four post-ponements (and God alone knows how many more), parent's are left out in the cold. Will 3-4 days NOW suffice? I'm extremely skeptical .. finger's crossed!

We should be happy that case is going seriously by analysing all pros and cons. Let us wait and get a complete solution.

I agree with Latha ji and Sumit Ji......Believe me comparing to all other matters and process that delay a case in court this is going fine....the only delaying factor was Govt submitting their part of affidavits/documents very late in the court.....Other then that court seems to be working hard and serious about the matter. Also, it will be very important decision as it will affect most of the households so it must be thought through thoroughly :)

@Manu: Thorough thought process is welcome! However, time is of essence here. We're staring at the first list and on the anvil of a second list. What's the point of coming out and saying Formal education will be 4+ one month into the session? Let the courts clarify that any decisions would be applicable only from next session and take all the time they want to do an in-depth study

@Rahul: Things are not yet clear. We would need to wait for the verdict of the court on Feb 10th. If the courts ok Formal education age at 3+, you get automatically promoted next year. If not, well ... let's just wait and see what the courts say!
