The Delhi High Court today refused to grant interim stay on its single judge verdict quashing the point-system for nursery admission brought in by  the Lieutenant Governor for private unaided schools here.

NEW DELHI: The Delhi High Court today refused to grant interim stay on its single judge verdict quashing the point-system for nursery admission brought in by  the Lieutenant Governor for private unaided schools here.

A bench of Chief Justice G Rohini and Justice R S Endlaw dismissed the application for interim stay moved by the education department of Delhi government, saying it will hear the main appeal on merit on January 15, 2015, the next date of hearing.

"The application is dismissed," the bench said.

The court's order came on a plea moved by senior advocate P P Malhotra, appearing for the Delhi government's Directorate of Education (DoE), contending that "there cannot be any discrimination or question of autonomy in the matter of admitting children around three years of age in nursery".

The single judge had passed the order on November 28 while disposing of two petitions by a committee and a forum representing the private schools which had challenged the LG's December 18, 2013 and December 27, 2013 notifications by which the points system was introduced.

The application by the DoE had contended that the single judge order was "totally wrong", "erroneous" and "against the law" and did not appreciate the correct legal position and scheme of Article 21 (Protection of Life and Personal Liberty) and Article 21-A (Right to Education) of the Constitution.

"The judge erred to hold that if parents are given freedom to choose school, the good schools would attract more students and would expand and not-so-good schools would lose students," the petition had said.

"The judge has failed to consider that education is a paramount consideration for the welfare of the society and in this, there are several participants...

"Quash and set aside the impugned judgement dated November 28 with all consequential benefits and reliefs," the government had pleaded to the court

NEW DELHI: The Catholic schools of Delhi are "going ahead with nursery admissions." Instead of waiting for the outcome of the court case on nursery guidelines, the Delhi Catholic Schools Association announced the decision at its monthly meeting on Monday.

"We have left the dates to each institution but since December is a very busy month for us-because of Christmas-most of us are likely to start distributing forms from January 1," says Sister Nirmalini, principal Carmel Convent and a member of the association. She adds, "If a common schedule comes, we will follow that-like we did last year-but for now, this is the decision. We aren't waiting for the court case."

School authorities discussed the criteria as well and any changes from last year are unlikely. "The Christian community will be given preference, then neighbourhood or distance, alumni and sibling," says Sister Nirmalini. Co-education schools are likely to allot points for "girl child" as well.

The association has over 30 schools that can accommodate anywhere between 100 to over 350 students each. The minority institutions had been covered by the December 2013 nursery guidelines and had challenged them and won a stay. These schools had objected to both the fixing of criteria and points allotted to them as well as the inclusion of a 20% free quota for EWS students in schools on government land.

I do agree with Sanjay.

By when will we get to see some light on the admission process .....when are the schools expected to give out forms for nursery admission... 

It's so frustrating that our institutions repeat the same chaos every year. Or perhaps there is a conscious attempt to create chaos. Why these cases and litigation have to happen at the 11th hour. In my opinion this is a conscious attempt with both DOE and Pvt schools being hand-in-glove to create unnecessary confusion and chaos which leads to panic among parents, using which the schools can arm-twist the parents. Isn't this the pattern over last couple of years... seems like new modus operandi for justifying donations !

Your words of wisdom are required to comprehend today's order. 

a. What's the impact on start of admission process ? Since DOE is the body which releases admission notification; so would DOE wait for the case to come up in January and only after a decision has been made by the court, that they will release notification.

b. Or DOE will release the notification now

c. Or there is no need for DOE notification ? Would schools have their own schedules ?

In terms of my suggestion on points:

1) Distance points - based on slabs

2) Alumni points or first child or sibling

3)  Total of Mgmt and staff quota seats to be maximum of 5-7% 

4) Common admission schedule

5) Common body (DOE perhaps) for issuing guidelines and monitoring any corruption in admission process

Admission for Pre School (Nursery) will commence only after the notification/circular issued by Directorate of Education, Delhi. As per HC order, schools can set their own admission criteria. But schools have to follow a common admission schedule.

Neither DoE is coming up with any fixed schedule nor HC is allowing a stay. It will definately delay the process if the wait is until 15 Jan 2015 i.e. the schedule for HC double bench hearing. Parents have no clue about which direction to follow ... hhmm !!! Is there some conclusion to this awkward situation and what is the assurity that there will be no conflicting situations at the end of everything ?
