In a fresh move, a number of parents belonging to the interstate transfer category (IST) are all set to approach the apex court for admission of their wards to nursery wing of the private unaided schools in the capital. These parents, after a five-month long wait to send their kids to school, feel betrayed as the recent verdict of the Supreme Court (SC) that finally lifted the stay on admissions benefitted only those who went to court in the first place.

The SC order dated 7 May allowed city schools to resume the process of admissions while retaining inter-state transfer points, which, however, will be applicable from the next admission season. For this year, given the shortage of seats, the transfer benefits were given only to 24 candidates, whose parents had applied for relief against the scrapping of the points.

Saurabh Kumar, a resident of east Delhi, who is one of the parents now seeking legal recourse to get justice, said, “Since we did not approach the court earlier, I along with other parents have planned to file a petition in the court next week. Earlier, we could not think of taking the legal route, as we believed that the matter is already under the legal domain.”

He added, “My daughter had secured admission in four schools after which the transfer points got scrapped. Now, the ruling has also excluded us from its ambit so we stand nowhere. Our lawyer told us that the court is going to be closed for vacations from 12 May onwards and in such case getting a hearing will be difficult. But whatever be the case, we have to go the court now.”

While some city schools have started the session already before closing for summer vacations next week, a number of others are waiting for an official notification by the Directorate of Education (DoE). The DoE is in the process of reviewing the SC order to send a notification to schools regarding the admission guidelines.

“We are planning to file a review petition so that our kids too can go to school this year. There are many parents who have already missed one year of admission cycle for they could not get a seat. I had applied in nine schools this year and finally secured admission in three. My child will not fit the age criteria next year. This judgment has left us with no option but to move court,” said Manish Gupta.

Interestingly, all the petitioners had applied for seats in the few top schools including DPS R K Puram, DPS Vasant Kunj, Vasant Valley International, Springdales School and Bluebells International, among others. D R Saini, principal, DPS R K Puram, told this newspaper, “We received the DOE notification only today. We are going to have a meeting shortly to decide when we can start the session for nursery classes. Based on the SC order and DoE guidelines, we will decide on how to adjust the transfer category students.”

Sumit Vohra, founder of admissionsnursery.com, an online forum for parents, said, “This year history was created as nursery admissions session lasted for five months. However, the roller-coaster ride ended with the SC order, but still left many parents without any relief. Unfortunately, I don’t see chances of these parents getting relief through the legal recourse, for the SC has already mentioned that it will not entertain any more transfer petitions. The court is closing from 12 May and vacation bench might not entertain any plea. This has become a sad scenario since litigations have become the only solution for those seeking good education.

I agree with Saurabh Kumar . Because of all these confusions of DOE and Court the genuine IST cases are the biggest sufferer. I am happy for all the kids whether it is transfer case or non transfer who got the admission but at the same time would like to request Mr. Sumit Vohra and AN team to raise there voice against all such in justice as they have done same when the genuine IST cases got the admission in Feb and afterwards before one day it got cancelled after the genuine 70 pointers raised the voice. I request all the genuine cases to raise their voice so that in future the government and DOE will form the rules and decisions responsibly . These guys don't know how much we have suffered .

Now Delhi Govt has finally removed transfer points but we accept it was not fair to all transfer pointers.

Well, IST for nursery makes NO sense today, 2morrow and day after, and for mid-session in every class it makes more sense than any other category. However, yes, IST people have been betrayed. If not all, majority would have applied for at least 20 more schools  if they would not have got those 5 mystery points initially and their wards name would have been in draw of lots in many middle level schools where these people never cared to apply as they were not in top 10 schools. I do agree chances of admission would have been much higher for these kids, and would have been fair for these and other other 70 pointers too. But, to my agony , the way these people have NO mercy for people born in this state who along with their parents have given their every thing to this city and presence of IST is a slap at existence of 70 pointers ( as if bearing a first child is a curse if u r a delhitie), sounds like its survival of the fittest and delhities survived this time..

I pray DOE does NOt has IST next year.. if it does I will assume that government is a group of jokers working together to form a  circus and bring mango people to do that circus..

Dear Pankaj , thanks for your feedback and I pray to god that you should not face this type of situation anytime i.e. in any case in future you should not get any job transfer or relocation. Pankaj , in all the big cities in India they have ist points . I agree becuase of fake cases genuine Delhites should not suffer but at the same time there was very good procedure and checklist was there which all school would have followed to check all genuine transfer cases. Anyways there is no point to argue this and I am in favour that now all this mess should end. but my only concern is DOE and Government should form good policy in future so that we will not suffer in the future
