@sakshi maam You are right we all have to wait for the order of hon. Supreme court.
And mr vohra is truly said that this year the admission process is halted for many times due to different PILs and DOE have to come up with 15 different guidelines. I think this year only such a mess happened....
Dear All
Lets wait as HON Supreme Court will decide .
RAJAT
HC IS NOT ABOVE SUPREME COURT
AS PER THE SC ORDER THE LAST 3RD APR ORDER IS ON STAY .
Sakshi - with all due respect, when you say lets wait for the SC, there is no sanctity to that...since the IST parents did not "wait" and abide by the various orders which came before that.. I think if we just stand by and let the IST cases dictate the future of all those who have paid fees etc, there is no coming back. Again as a lawyer, my understand is that the SC stay order is to allow the HC to decide the matter regarding IST points before school session starts which is why I said earlier that what matters is what happens on the 16th in the Delhi HC.

please see yesterday quote of Mr Vohra from Hindu paper
“This is the third time nursery admissions have been stayed in the last two months. There have been more than 15 notifications from the DoE. The ball is now in the Supreme Court, so whatever decision comes will be final and binding on all ” said Sumit Vohra, who runs the information service admissionsnursery.com .
NOW SC COURT WILL DECIDE . LETS WAIT ..
If the traffic light is broken, you can not penalize people for jumping it. The only logical way forward is try to fix it / man it with a policeman and those who crossed while it was broken can not be penalized.
This obviously does not mean that you can not be penalized for pollution/drunk driving/ helmet violations (Fake IST) just because the light is broken.
You can not create a traffic jam while holding the complete traffic (admissions). Obviously everyone is in a hurry to get to their destination (Nursery seat) and will try whatever way they can to get ahead. Name throwing is a Delhi tradition.
Once the handful of genuine drivers (IST) are let through, traffic can resume normally. Traffic light (guidelines) can be fixed once the jam clears.
You can also say, reset everything, fix the light (Scrap Tfr points) and everyone get behind the stop line (Fresh redraws). This would create a bigger jam and take long time to clear. Still, it would be fair for all.
Selective clearance is not the solution. White cars (IST), wait for instructions and rest all (70 pointers) continue onwards.
Having said all this, none of the solutions is feasible now. It is just to say, things could have been handled much better if there was some clear guidance.
I think the HC hearing on April 16 on the IST case is going to be pivotal. Since more than 90% of parents polled by AN want these IST points to be scrapped, we must find a way to show the majority view to the HC on the April 16 hearing.
@Sakshi - can you please let me know who were the lawyers involved last time the matter of the IST points was heard by the HC/SC? Based on the AN poll and other feedback, the DOE had scrapped the IST points and the HC had blessed this in one of its orders. Please let me know who were the lawyers involved. Thanks in advance.
@RK
how do you think a handful of IST parents are able to pay senior counsel to appear before SC?
I think we are digressing from the point here - if parents whose kids have got admission do not do something collectively to show the SC that most parents are against IST points as a concept itself, then the SC may think that this petition has the support of the majority. Secondly to say that this is justified because the they did not even demand these points is completely counterintuitive. I also believe that the division bench erred in overruling the single judge since effectively it penalises the genuine IST cases who are effectively put at par with the 70 pointers but without the benefit of the draw at 70 points. which is why they have gone to SC where their best bet is to challenge the constitutionality of the scrapping of the transfer points after the first draw was done based on the 5 points given to IST cases.
Now on the way forward, since all polls and majority view of most non-delusional people is that IST points should be scrapped as a concept, unless the parents whose children have got admission come together to protest the stay granted by the SC and demonstrate to the court that only a handful of people are fighting for these IST points, we will not do justice to our kids by just sitting back and hoping that the court does the right thing. Unfortunately, no matter what you do, given that limited number of seats, some parent group is going to be unhappy. what parents should realise is that once parents make a choice of one school over the other, then the 2 and 3 list comes out and many more children get admission. by court interference, the matter just gets stuck. If anyone has read the ganguly committee report, it is very well thought through recommendations are what should have been implemented. Everything started with the so called "educationalist" LG how came out with ridiculous guidelines in December. how is it that in the past, over the course of 1, 2 and 3rd list most children get admission in a good school but only this year, we are sitting on 13 April at the mercy of the DOE and the courts. Private schools had done a much better job in managing their affairs. whenever the govt gets involved in private sector they just screw things up for everyone..
I think we need to be very careful since the matter is before the SC. We cannot let a handful of IST parents hijack the admission process. I think everyone agrees that IST points never make any sense. Even genuine cases, why should someone who has come to Delhi in the last 1 year get preference over someone who has spent the last 20 years in Delhi? this completely defies logic. For mid-year transfer cases, most government schools and army and airforce schools allow a certain percentage to move in the middle of the year. Now parents with fake or genuine IST points have gone to the SC. If other parents whether alumni or 70 pointers who have got admission do not come together and protest, the SC might think that the IST pointers have support of most people which is completely false.
Does anyone have a complete list of matters and advocates appearing in these cases? we must find the right senior counsel and team to support the case of people who have already got admission. I am open to suggestions i.e. Dharna etc but my suggestion is that we gather support of parents on AN and then make sure that either the DOE or the schools lawyers are fighting for parents whose children have got admission.
