Media Reports - The worst sufferers are 70-pointers who haven't got admission - parents are demanding that the schools refund fees, which was already collected by the schools for April-June quarter.

He added that since the apex court had scrapped DoE notification issued on February 27 in which inter-state transfer quota was removed, there are lots of parents who are confused about the implication of points. As this year experienced the biggest nursery admission season of five months, parents are demanding that the schools refund fees, which was already collected by the schools for April-June quarter. Parents demand that fees should either be refunded or adjusted in the next quarter by giving some rebate or concession

The Supreme Court’s verdict in the inter-state transfer case for nursery admissions on Wednesday has elated the petitioners. But, some parents are disappointed with the same and are contemplating to move the court on Thursday.

Many parents who were not able to move the Supreme Court in the inter-state transfer case said the apex court order is complete “injustice” and is a “selective mediation” just for few parents out of thousands others.
Mr Saurav Kumar, who comes under the inter-state transfer category, said that he was not satisfied with the verdict and is planning to move the court with the effort of few others parents collectively.

“There are about eight parents in the group. We have hired a lawyer and tomorrow we will decide whether it is possible for us to file a review petition in this matter or not,” he said. Another parent, Ricky Khorana, said that the Supreme Court has done a “selective mediation” by giving relief to only those parents who have filed the petition, as there are about 2,800 parents under the inter-state transfer case.

NEW DELHI: The Supreme Court decision on nursery admissions which benefits 22 parents has pleased them as well as applicants with just neighbourhood points. The first group feels justice has been done; the second feels the damage to their chances has been contained to 24 seats. But the order has displeased the other interstate transfer (IST) cases not party to the petition-the "fence-sitters"-enough that they are now considering legal action. The alumni lot too is afraid to rejoice just yet-because the SC order also quashes the February 27 scrapping of the five IST points, even if it is only for the 24 candidates.

"The 70-pointers will benefit from this ruling as only 24 applicants will get the five points for inter-state transfer," says Kamal Batra of Vikaspuri, who counts himself among those who've "benefitted" from the SC order.

"The remaining other ISTs have been excluded and the rest of the seats will go to 70-pointers." he says. Kumar Saurabh, one of the petitioners, gets to keep the seat he got for his son on the basis of the original, December 18, guidelines. "There is still justice in this world,"

He says, "It does pay if you fight it out. We'd work 12 hours in office then meet the lawyer and work over the strategy. In between, we'd coordinate with others for money." It's been an expensive fight but as Saurabh puts it, all 22 petitioners agreed they'd rather spend on a case than "spend the money to get admission in an underhand way." Though the SC order has been in his favour, he says, "I believe justice is not the prerogative of the person who seeks it."

East-Delhi parent Manish Gupta says, agrees. An IST-category applicant who wasn't among the petitioners feels cheated.

"We are trying to see how we can pursue this and get relief for other parents. There are about 1,500 other IST applicants, what about them? People may not go to court because they lack the means or knowledge. This is injustice!" Gupta had initially applied to over nine schools, thinking he had a good chance of getting in with 75 points; the score was later downgraded to 70 points when, on February 27, Delhi government scrapped the transfer points were scrapped and he subsequently failed to make it through any of the 70-points draws. He is getting parents together to go to court.

The remaining ISTs going to court is exactly what Digvijay Singh fears. An alumni-category applicant, Singh had managed a seat after the transfer points were scrapped and seats freed. Singh is worried that the SC has, as Saurabh puts it, "acknowledged that scrapping the transfer points mid-way was wrong."

"If 100 parents approach the court, we could be back to square one because SC has said the December 18 guidelines were right," says Singh. The IST category were allotted the same number of points in the 100-points system as the alumni-five-and the later category had benefited most from the scrapping of IST points. Also, as Singh points out, IST applicants will get the five points in all schools they apply in but alumni will get them only in one.

"Most parents with confirmed seats who've paid fees are happy. Few parents have also been called to collect uniforms tomorrow. The worst sufferers are 70-pointers who haven't got admission anywhere," say Sumit Vohra of admissionsnursery.com. , "Also, many are simply confused and are wondering if the SC's upholding the December 18 guidelines, even if it's for only 24 applicants, will impact their chances."

SCHOOLS AWAIT OFFICIAL WORD Mail Today/ New Delhi WITH the Supreme Court clearing the decks for nursery admissions in the Capital, schools are waiting for directions from the Directorate of Education ( DoE) to decide their course of action. Most of the schools welcomed the end of the legal impasse on nursery admissions but expressed unhappiness over the delay. “ We are waiting for guidelines from the DoE as we can only take our next step after that. Parents and students are suffering owing to the immense delay in the whole process,” said Rekha Bakshi, head of junior school, Vasant Valley. The DoE has not yet issued any official notification regarding the order and the schools are thus not yet ready to spell out a clear plan for the days ahead. “ Until the DoE doesn’t give an official notice, nothing will be conveyed to parents from our side, as it will only add to the confusion that is already in plenty,” Springdales School principal Ameeta Mulla Wattal said. Officials at the DoE said they are likely to come out with a notice on Thursday. “ We are reviewing the order and will issue the notice by tomorrow,” said Padmini Singla, Director of Education.

The nursery admission fiasco has also given rise to many other problems. Many parents who have submitted the fees to schools are demanding that the money be adjusted against fees for forthcoming months as their kids had not attended school even one day.

THE Supreme Court decision ending the admission stand- off was largely greeted with immense relief by parents. “ We are very happy that our plea has been heard and our kids will be now going to school. What was done to us was not fair but now we are satisfied. However, I feel it would have been much better if a fair chance was given to all genuine transfer cases.

There are many who could not take legal recourse because they don’t have the financial resources or are too new to Delhi,” said Kumar Saurabh, one of the litigants whose petition the SC issued Wednesday’s order on. However, the order brought much disappointment to parents whose students were eligible for the inter- state transfer benefit.

Soon after the order was issued, many among the latter had begun planning on seeking legal recourse as they feel the SC verdict has left them with nothing.

“ We did not approach the court earlier as we do not have money to spend on legal proceedings.

We were hoping that some relief will be provided as many other parents had approached the court. But now we have no other option but to approach court,” said Subhash Jha, a resident of Khanpur.

Schools will be soon going into summer vacation, only to reopen after June. “ I have paid the full fees for the first quarter but my child has not attended classes one day. Now the decks have been cleared for schools to open but it will be only fair if the school adjusts the fees in the next quarter.

Schools are going into vacations and the fee we have paid is for nothing,” said a parent whose child has been admitted to a school in Paschim Vihar.

Apex court verdict a relief for some parents, others plan legal recourse

Schools and parents heaved a sigh of relief on Wednesday after the Supreme Court vacated its stay on nursery admission in Delhi. “The court took a lot of time to lift the stay, but eventually did it just in time. Hopefully, schools should be able to finish all formalities before breaking for summer vacations,” R C Jain, president, Delhi State Public Schools Management Association, said.

Lifting the stay on nursery admission, the apex court held that parents who have moved court against the Delhi government’s decision to scrap the Inter-State Transfer (IST) will get seats for their children this academic year. The court also quashed the government’s February 27 notification scrapping the IST quota.

“We welcome the decision of the court. Schools can start nursery classes from tomorrow, but we first want to start the admission process for the remaining seats. We will be admitting the 22 children — whose parents had gone to court — into schools of their choice, as directed by the court. We are awaiting the instructions of the Directorate of Education (DoE) to begin the process,” S K Bhattacharya, president, Action Committee for Unaided Private Schools, said.

“If all goes well, we are hopeful of beginning classes in a couple of days or beginning of next week,” he said.  The DoE is expected to release the schedule for nursery admission by Thursday. “We only need to wait for the DoE’s circular to get the process going. Most schools are open till May 16, so we hope to finish by then,” Ameeta Wattal, principal, Springdales, Pusa Road, said.

“Parents who have got confirmed admissions in schools are really happy with the order. But those  who haven’t been able to secure a seat for their children, especially ones with IST points, are planning a legal recourse,” Sumit Vohra, founder of parent portal admissions nursery.com, said.

“We did not know that if we did not go to the court, we would not get a seat. The judgment is for the lucky few who could afford going to court. We are also contemplating challenging the SC order to get some respite,” Subhash Jha, an IST parent from Patna, said.

नई दिल्ली। सुप्रीम कोर्ट के स्कूलों में नर्सरी के दाखिले पर लगी रोक के हटने के बाद जहां कुछ पैरेंट्स को राहत मिली है, वहीं इस आदेश के जरिए राहत की उम्मीद करके चल रहे काफी अभिभावकों को झटका लगा है। दाखिले 18 दिसंबर के नोटिफिकेशन के आधार पर होंगे।
इसके साथ ही इंटर स्टेट ट्रांसफर वाले अभिभावकों के बच्चे को भी एडमिशन मिलेंगे। हालांकि इस मामले में उन्हीं अभिभावकों के बच्चों को दाखिला मिलेगा, जिन्होंने अदालत का दरवाजा खटखटाया था।
एडमिशन नर्सरी डॉट कॉम प्रमुख सुमित वोहरा ने कहा कि अब 70 अंक वालों का भविष्य फिर से अधर में है। पहले भी 70 अंकों वालों को दाखिला नहीं होने की परेशानी हो रही थी। कई स्कूलों में ड्रॉ के बाद दाखिले हो गए थे और फीस भी जमा हो गई थी। लिहाजा उनके तो दाखिले पक्के हो सकते हैं। वहीं, अभी तक यह समझ नहीं आ रहा है कि इंटर स्टेट ट्रांसफर के लिए क्या फॉर्मूला रहेगा। स्कूलों में कितनी सीटें बची हैं, इसका भी पता नहीं है। अब अभिभावकों की निगाहें निदेशालय के आदेश पर टिकी हुई हैं।
सुप्रीम कोर्ट के आदेश के बाद से निदेशालय में बैठकों का दौर शुरू हो गया जो देर शाम तक जारी रहा। संभव है कि निदेशालय बृहस्पतिवार को कोई आदेश जारी करे। मालूम हो कि सुप्रीम कोर्ट ने 11 अप्रैल को दिल्ली हाई कोर्ट के तीन अप्रैल के निर्देश पर स्टे लगाते हुए नर्सरी दाखिले पर रोक लगा दी थी।
पैरेंट्स कोर्ट जाने की तैयारी में
जो अभिभावक कोर्ट गए, केवल उनको राहत मिलने से बाकी अभिभावकों में निराशा है। लिहाजा वह कोर्ट जाने की बात कह रहे हैं। जबकि काफी पैरेंट्स चाहते हैं कि अब बस इन सब का अंत होना चाहिए और दाखिले शुरू होने चाहिए।

दिल्ली स्टेट पब्लिक स्कूल मैनेजमेंट एसोसिएशन के अध्यक्ष आर.सी जैन ने कोर्ट के फैसले को देर से आया दुरुस्त फैसला बताया। रोक हटने से स्कूल बृहस्पतिवार से प्रवेश प्रक्रिया शुरू कर सकेंगे। स्कूलों के साथ-साथ इस फैसले से पैरेंट्स की दुविधा भी समाप्त हो जाएगी।

नई दिल्ली (एसएनबी)। पब्लिक स्कूलों में नर्सरी दाखिले पर लगी रोक हटने से कुछ अभिभावकों को तो राहत मिल गई है, लेकिन इंटरस्टेट ट्रांसफर कोटे वाले वे अभिभावक, जो कोर्ट नहीं गए थे और 70 प्वाइंट्स वाले उन बच्चों के अभिभावक, जो इंटरस्टेट के साथ ड्रॉ की उम्मीद में थे, की उम्मीदों पर पानी फिर गया है। ऐसे अभिभावकों के बच्चों को एडमिशन मिलना अब मुश्किल है। सुप्रीम कोर्ट के आदेश के बाद अब उन 24 बच्चों का दाखिला हो सकेगा, जिनके पेरेंट्स कोर्ट की शरण में गए थे, लेकिन बाकी इंटरस्टेट कोटे के बच्चों का एडमिशन अधर में लटक गया है। शिक्षा निदेशक पदमिनी सिंघला ने बताया कि इस संबंध में बृहस्पतिवार को आदेश जारी किया जाएगा। पीतमपुरा स्थित एमएम पब्लिक स्कूल की प्रधानाचार्य रूमा पाठक ने कहा कि अब कोर्ट न जाने वाले अभिभावकों के बच्चे को दाखिला मिलेगा या नहीं, इस पर संदेह है। इसकी वजह यह है कि कोर्ट ने पिछली सुनवाई पर और इस बार भी यह साफ किया है कि दाखिला उन्हीं बच्चों को दिया जाएगा, जिनके पेरेंट्स कोर्ट की शरण में आए हैं। हालांकि शिक्षा निदेशालय का जो भी आदेश होगा, उसका पालन किया जाएगा। आरकेपुरम स्थित रामजस पब्लिक स्कूल की प्रधानाचार्य रचना पंत ने कहा कि जो अभिभावक कोर्ट नहीं गए थे, उनके बच्चों को दाखिला मिलना मुश्किल नजर आ रहा है। हालांकि स्कूल शिक्षा निदेशालय का जो भी आदेश होगा, उसका पालन करेगा। एडमिशन नर्सरी डॉटकॉम के प्रमुख सुमित वोहरा ने कहा कि वे अभिभावक काफी परेशान हैं, जो कोर्ट नहीं गए। उनके बच्चों का क्या होगा, यह निदेशालय के आदेश के बाद भी पता लग सकेगा।  सुप्रीम कोर्ट के आदेश से पहले तो इंटरस्टेट कोटे के साथ 70 प्वाइंट्स वालों का ड्रॉ निकालने की स्थिति बन रही थी। वोहरा ने कहा कि कई स्कूलों में दाखिले की सेंकेंड लिस्ट निकाली जा चुकी है जबकि कई स्कूलों ने अभी सेकेंड लिस्ट नहीं निकाली है। ऐसे में वे अभिभावक काफी परेशान हैं, जिन्हें सेकेंड लिस्ट में अपने बच्चों का नाम आने की उम्मीद थी। शिक्षा निदेशालय आज जारी करेगा नर्सरी दाखिले को लेकर नया आर्डर

please how are 70 points worst sufferers? now they will get 1500 IST seats minus the 24. its just that all the nursery parents are sufferers in this session as they had to undergo such waiting and stress!!!

yes for the next session, those parents who have not secured a seat till now, should organize themselves and move to court for changing these guidelines for the next session.
1. all sibling allowed (justified)
2. quota for alumni.
3. management quota, even if only 5% with permission to school to charge increased amount of fee as in the case of self-financing seats in college. (that fee can be used for free education to EWS without burdening general category!
4. 2-3 seats/ 1 % for IST. (abolishing altogether will be better, let them go through DOL like general category delhiite once they becomes a delhiite themselves, without getting privilege to get admissions in top school on priority.)
5. 5% girl quota
6. 25% EWS.
7. 5% staff quota.
8. 5 points to the first child.
9. gradient neighborhood points. so the person living in that area and walking distance gets most of the benefit. A will not have to travel 8 kms to go to B area school, and the B will not have to travel 8 kms to go to A area school.

Not more than 50% should be reserved in any case. those 50% or more seats should be available for general category only.

The greatest sufferers are the 70 pointers. Injustice has been done to them, who kept silent for whole procedure, and watched for the verdict from court.. they were the innocent people. The court felt that the concession should be given to the parent who approached court, why don't they think that it is only because of them that all others suffered, what about the time wasted in all this and the studies affected as such, and what is done for the parent who have deposited the quarter fees without any classes offered to their kids, what about the confusion and stress created to the schools and parents affected by this case from the beginning,..... court decision is not at all justifiable. Those 24 parents should not be benefitted as such.

NEW DELHI: School authorities are generally pleased with the order, as they won't have to increase seats.

"As far as schools are concerned, the matter's been resolved for 2014-2015 and admissions will begin as soon the Directorate of Education notifies the order," says S K Bhattacharya of Action Committee of Unaided Recognized Private Schools, "The DoE has to issue guidelines on how the remaining seats are to be filled." The DoE is likely to notify the order and issue fresh guidelines on nursery admissions on Thursday.

Some school authorities, however, are waiting to see the guidelines before commenting and are wondering if the seats still remaining vacant have to be filled according to the December 18 guidelines or the February 27 one. "There is nothing in the order on how the remaining seats are to be filled-as per the 95 points or 100 points system. The order has upheld the December 18 guidelines but only for the 22 petitioners. This may create complication, even lead to litigation," says lawyer-activist Khagesh Jha.

The court had previously enquired of the government whether it would be possible to increase seats in schools to accommodate the transfer cases this year. School bodies had met officials at the directorate and explained all the reasons the number of seats couldn't be increased for all IST applicants. School bodies had argued that increasing seats would bring on another round of litigation as the sizes of quotas-Economically Weaker Section and Disadvantaged Category and girls-are computed on the basis of the total number of seats. Further, schools were afraid that this would also set a precedent-every time there's a shortage of seats, schools will be asked to increase them.

"It's taken time for the matter to be resolved," observes R C Jain, president, Delhi State Public Schools Management Association. "But we're all breathing a sigh of relief. Schools that have completed admissions can start classes and others can get done with the admission process. We are just glad that the issue was decided before the summer vacations."
