Why draw of lots in nursery admission be not held afresh?: HC

The High today asked the city government to inform it why draw of lots in nursery admission be not held afresh for all seats under neighbourhood scheme instead of just for those seats which were vacated after inter-state transfer category was scrapped.

Justice Manmohan asked the counsel for the government to take instructions from the directorate of education and listed the matter for further hearing tomorrow.

The court was hearing a plea against city government's decision to do away with the system of allocating points to inter-state transfer cases of children seeking admission in nursery classes here.

Delhi government had on February 27 issued a notification scrapping the inter-state transfer category under which it used to give five points to children whose parents have been transferred to the national capital from another state.

The notification was issued by the government after it admitted in court that there was misuse of the inter-state category.

The petition challenging the February 27 notification as being "totally arbitrary and unjustified" has been filed by Major Saurabh Charan and some other parents who have sought quashing of the government's decision to do away with the inter-state transfer category.

The petition has also sought directions to the government "to confirm the list of successful candidates/applicants including the children of present petitioners published by the schools prior to the passing of the impugned notification/ order..."

In the alternative, they have sought that draw of lots be conducted afresh for all seats under neighbourhood category by cancelling the entire draw held prior to February 27 and not just of those children who had availed of the benefit of the inter-state transfer category.

Under the earlier system, out of the total 100 points, 70 were given if the child lives in the neighbourhood of the school, additional 20 were given if a sibling is studying there, five points more if either parent is an alumni and another five points if it is an inter-state transfer case.

Those having 90 or more points are directly admitted while the rest have to undergo the draw of lots for admission.

the court has stayed only that part of DoE order of 27 Feb 14 which stated that those 70 pointers who had been successful in earlier draw of lots would retain their seats and fresh draw for only the seats vacated by the transfer points would be held amongst all 70 pointers.

It means fresh draw for 70 pointers for all the seats taken together.

It doesnt mean redraw for any other category including girl child. The order only seeks to give equal opportunity to those 70 pointers who were earlier at 75 because of TP.

I agree and this is the correct interpretation. All categories are not to be redrawn.

The example cited in court has not been factually correct. As per example cited out of 100 seats 10 were occupied by 75 (transfer cases ) and 90 by 70 pointers.

While in reality only in very few schools 70 pointers were selected in first draw.

Do clarify what would be the guidelines for schools in which no 70 pointer was selected in first draw , but on second draw done post 27 Feb, few 70 pointers were selected which included the transfer cases as well (with point revised to 70 ) and were a part of draw..

If no 70 pointer was selected in the first draw, it would mean that all the seats went to 75 and above. Thereafter some seats got vacated because some 75 pointers (ex TP cases) became 70 pointers.

In such a situation, a second draw of lots would have been conducted for the seats vacated to be filled from amongst ALL the 70 pointers (including the ex transfer points). Thus all the 70 pointers got equal opportunity for the seats in question. Hence NO REDRAW required in such a case.

Please see the operative part of the judgement which I quote,

"Consequently, only direction No. 3 of the impugned Order dated 27th
February, 2014 is stayed and it is directed that all candidates having equal
marks shall be considered equally by conducting a fresh draw of lots, wherever
necessary."

The words "WHEREVER NECESSARY" need to be emphasized. And this 'necessity' is only to ensure equal opportunity WHEREVER it has not been there. Thus, draws held earlier are not to be scrapped in toto unless the question of 'equal opportunity' was attracted in such a case.

the concern of the transfer cases is ..that earlier they had got seats without draws because of their 75 or above points. Now, that benefit has been taken away from them. In addition to their getting seats, some seats must have also gone to 70 pointers as a result of draws.

Now, 75 pointers became 70 pointers....and have been asked to compete with remaining 70 pointers from previous draws. So, the remaining 70 pointers get a second chance but the newly created 70 pointers (who were earlier 75 pointers) get only 1 chance and that too in competition with so many..to ab unki jali...jab 5 point extra mile to bade khush the....

@NG I think the redraw will happen for all seats for general category (not girls quota, and ews). Lets say pre feb 27, we had A set of 70 pointers and B set of xfer cases who had seats in a school. Now after post feb 27, the draw would mean A set of 70 pointers and C set of 70 pointers (including xfer cases who participated in the draw). If after today's order, the redraw now happens for only A set of seats, then A ppl will go to court with the same logic which xfer cases gave. Hence the redraw should happen for all seats of general category.

What I understand from the judgement is the few schools which have had draws for 70 points candidate before the judgement of 27th feb have to go for redraw, rest of the schools which have conducted draws fro 70 points after the judgement of 27 feb stays as it is. Am i correct in interpreting the same

The uncertanity of Nursery Admissions would have definitely made many parents close friends and many a foe ( depending on points each one has ) :))

I hope the parents dont have to fill up forms afresh now!! The schools already applied to by us will use the existing forms for fresh draws. Please correct me if i am wrong!
