Why draw of lots in nursery admission be not held afresh?: HC

The High today asked the city government to inform it why draw of lots in nursery admission be not held afresh for all seats under neighbourhood scheme instead of just for those seats which were vacated after inter-state transfer category was scrapped.

Justice Manmohan asked the counsel for the government to take instructions from the directorate of education and listed the matter for further hearing tomorrow.

The court was hearing a plea against city government's decision to do away with the system of allocating points to inter-state transfer cases of children seeking admission in nursery classes here.

Delhi government had on February 27 issued a notification scrapping the inter-state transfer category under which it used to give five points to children whose parents have been transferred to the national capital from another state.

The notification was issued by the government after it admitted in court that there was misuse of the inter-state category.

The petition challenging the February 27 notification as being "totally arbitrary and unjustified" has been filed by Major Saurabh Charan and some other parents who have sought quashing of the government's decision to do away with the inter-state transfer category.

The petition has also sought directions to the government "to confirm the list of successful candidates/applicants including the children of present petitioners published by the schools prior to the passing of the impugned notification/ order..."

In the alternative, they have sought that draw of lots be conducted afresh for all seats under neighbourhood category by cancelling the entire draw held prior to February 27 and not just of those children who had availed of the benefit of the inter-state transfer category.

Under the earlier system, out of the total 100 points, 70 were given if the child lives in the neighbourhood of the school, additional 20 were given if a sibling is studying there, five points more if either parent is an alumni and another five points if it is an inter-state transfer case.

Those having 90 or more points are directly admitted while the rest have to undergo the draw of lots for admission.

I am a mother of a 3.5 year old daughter seeking nursery admission in Delhi this year.

I am appalled at the system and mess that has been created.

Coming from a services background (my family has served in Defence services for last 3 generations), I am married to a salaried civilian, staying in Delhi for over 10 years. 

1) We now feel we are being treated as migrants. As I and my husband studied across India being children of fathers with govt. transferable jobs, we get 0 points in Delhi in all schools for not being alumni. Who cares if were distinction holders, schools toppers or gold medalists! 

2) My daughter is our first child and and therefore we get 0 points again. A child needs to be first born in order to have a sibling. 

With plain stroke of luck my daughter was one of the lucky children from the only draw of lots taken out for 70 pointers (no other school gave her a chance for even a draw of lots withing 8 kms as all seats were eaten by siblings, alumni and transfer cases.). Thanks to DPS vasant kunj for atleast being fare and vigilant before anyone blew the whistle.

Draw for 70 point for only 37 seats ( after school caught 37 fraud transfer cases) on 15 Feb 2014 was conducted infront of 1000s of parents. Just to let DoE and HC know that these were those 37 children from 1426 applicants who got through a lucky draw.

And now once again the system is set to tell us that this is null and void! WHY?

How is it unfair? Infact it was more unfair to us. It still is.

And why do we need girl child quota? We should be aiming for gender equality. And anyways everything is by draw of lots. So, where is the need for this quota? 

I am a mother of a daughter and I find it unfair to all the mothers with first born boys.

Grateful if these points are taken into consideration before any new ruling is announced (only to be challenged yet again).

I totally second your opinion @Harleen....all the points other than neighborhood points should be scrapped.

On one side we talk about right to education, and on the other we have points like sibling...which leads to sure shot admissions. If one child from a family gets to study at a good school should it entitle the siblings too??? at the cost of children from families who are not so lucky.  Are their children not entitled to goods schools....

These points make schools closed elite groups....schools like DPS EOK / Modern School have filled up all their seats using sibling / alumni points....closing their gates to all other parents.

Why we get only one chance and that's also for few seats which were vacated through Inter Transfer scrapped points.

First of all, there should not be re-draw for those who  have been selected through 70 points.

But, if Court decided for scrapping of all draw, then, now, we will go to the Court and ask for cancellation of Sibling point and Alumna Point.

If sibling point exists, then there should be point for first child.

I think sibling is valid but we should raise concern over alumni

Welcome to India ..... this is sad message. Corruption starts here right from birth of child, when we give bribe to get birth certificate. No wonder we have population growing like anything but infrastructure needed to support this population missing... namely schools, colleges, hospitals, transport, water, electricity and what not.

I am still not convinced that verdict of present case in HC will not be challenged further in SC. Then again all draws, redraws, fresh cases filed by another group of parents who think current point system is not fair.  Just pray to God that these people finalise and admit our childrens well before next year !!  

 

The first petition were by non selected 70 pointers, cause they were not lucky and they didn't want others to be lucky as well. They wanted redraw so that they have another chance at redraw; without thinking about the genuine transfer case child (they didn't ask for the extra 5 points, it was there so they applied). Now they all want redraw, how can these lucky ones got the seat and not me...so have the redraw.

My son is 4+,  70 points. Got a nursery seat in just one school. Lost one year. Last year too he did not get admission in any single school. You all will still get one more chance if God forbid not this year. If he is not lucky this year in this redraw then? What home schooling? will u choose that for ur child?

 

Really sad story and thats y we need a political change. We have govt schools and those are in so bad shape otherwise there was no problem like this.

Draw should be done only for the vacated seats from transfer cases. Not for all pls.

Right. Transfer cases applicants had equal right in Girl's Quota draw and all general category draw. I think they have strong and valid point. I am not transfer case either.

Simple common sense says that, if rules are being framed they need to be well thought. If LG had proposed extra points for transfer cases,he should have reason for giving extra points to transfer cases. On day HC judge asked what are basis for giving points for transfer cases, Delhi Govt( read LG ) had no answer and scrapped transfer points very next day !!!!!! If LG had any proper ground on which extra points were given to transfer cases, he should have taken firm stand in court.
