ADMISSION NOTICE HC seeks government stand on matter by November 23

The nursery admission row is back in the courts.
The Delhi High Court on Wednesday sought the Delhi government's stand on a plea for stopping various private schools from admitting children below four years of age in their pre-primary (nursery) classes.

Acting Chief Justice AK Sikri and justice Rajiv Sahai Endlaw issued a notice to the Directorate of Education and the Committee on Unaided Schools and sought their replies by November 23.

“Despite the court's orders and directions issued by education department, private schools gave admission to threeyear-old children.“

Lawyer Ashok Agarwal, appearing for NGO Social Jurist, accused the government of not enforcing the court's September 2007 order, which had asked it to implement Ashok Ganguly Committee's recommendations.

The Ganguly Committee had fixed four years as the minimum age for admission in pre-primary classes.

“This helped children prepare for admission to Class 1 in primary schools after the age of five years and without undergoing more than a year of schooling at pre-primary stage,“ Agarwal said.

Seeking directions to all unaided private schools to follow a uniform age criteria of four plus to admit students in nursery classes, the petition said it was a must to meet the statutory stipulation under Section 16 of Delhi School Education Act, 1973 that no child below five years in age should be admitted to Class 1 of a recognised school. TEACHERS AGREE WITH GANGULY COMMITTEE When asked to comment, most principals and education experts said that three years was too early an age to send a child to school.

Last year, in fact, many had raised their voice against the admission criteria that declared the minimum permissible admission age to be three years.

“This is a persistent problem. Some three-year-olds are not even toilet-trained. Nursery is the beginning of formal schooling but it becomes a part of early childhood schooling when children so young are enrolled,“ said Ameeta M Wattal, principal, Springdales School, Pusa Road While last year, the age for admission was three years, the year before that it was set at four years.

 

“The government needs to be clear about the implementation of the suggestions of the Ashok Ganguly Committee. Ideally there should be just one year of pre-primary education, the age of admission to which should be four years,“ said Sumit Vohra, who runs admissionsnursery.com, a website on nursery admissions in the NCR.

“We have said repeatedly that three years is too young,“ he added. ,

yes this news has brought up some good things  but a bit hesitation  for parents ,3 years is too early  age, but we all should get the  exact age criteria at least for this year  before  some private school start to issue the forms

I am really happy to see you post everything pertaining to education on this website. Timely updations help parents like us. But i feel, we need to make this a revolution to see this change possible in the system.

To bring a change in our country we require people like you who have taken the initiative and followers like us who need to drive this through. Take a moment to imagine how much a child has to suffer (harsh weather, toilet untrained and the the tender age).

While Indian education system is most rigorous and comprehensive and hence ALL INDIANS DO SO WELL IN ANY PART OF THE WORLD THEY GO TO!

We are with you. Lets try to make the government realise of this. Thanks to all the NGO's who have been actively working on this. I am sure, a child at the age of 4 is far more mature (in all his milestones) than 3 yrs.

Please let us know, how can we make this possible. Lets try to make this a movement.

How can we ensure 4+ this time? Can we make some sort of a joint effort? Something that ensures this noble step....

Last year on the same PIL... .Govt asked for Some time and gave affidavit in court that it will make 4 yr as entry level but needs some time to build infrastructure for nursery... so cannot say what will happen this year  

My point is if this order is implemented then this should be implemented across India rather than only in Delhi so that a child will not suffer and gets equal consideration all over India.

I agree with you but this is state subject ..like noida /gurgaon conducts interviews of kids even after implementation of RTE but delhi doesn't !!

Don't you think Mr. Vohra it is mockery of the RTE Act.

Pls see my complaint to DIrector Harayana Education against 5 school in gurgaon and even after Chairperson NCPCR intervened no action was taken against any school

Sir/Madam,
I am directed to say that the National Commission for Protection of Child Rights (NCPCR) has been constituted under the provisions of the Commissions for Protection of Child Rights (CPCR) Act, 2005 for protection of child rights and other related matters. One of the functions assigned to the Commission under Section 13 (1)(j) of CPCR Act is to inquire into complaints and suo motu cognizance in relation to deprivation and violation of child rights.  
 
 
2.        The Commission has received a complaint (a copy of the complaint is enclosed) dated 29/08/2011 from Smt Vohra President. The gist of the complaint / allegation is as under:  
"Denial of admission and conducting screening test for admission to children by Scottish High International School, K. R Mangalam school, Salwan Montessori school, Suncity school, Bluebells Public school (all in Gurgaon). The complaint is self explanatory which may kindly be perused."
 
3.        After perusing the complaint, the Commission has taken cognizance of the matter and directed that the matter be referred to you for investigation/inquiry and report to the Commission.
 
 
4.        You are accordingly requested to get the matter investigated and take further necessary action. A factual report, along with authenticated copies of the relevant documents, be sent to the Commission within 15 days of issue of this letter. The Report should indicate inter-alia the information on the following points :  
 
  1. Section 13 of Right of Children to Free and Compulsory Education Act 2009 states that no school or person shall, while admitting a child, collect any capitation fee and subject the child or his or her parents or guardian to any screening procedure. Any school or person, if in contravention of the provisions of sub-section (1), subjects a child to screening procedure, shall be punishable with fine which may extend to twenty- five thousand rupees for the first contravention and fifty thousand rupees for each subsequent contraventions.
  2. Section 15 of RTE Act 2009 provides that a child shall be admitted in a school at the commencement of the academic year or within such extended period as may be prescribed: Provided that no child shall be denied admission if such admission is sought subsequent to the extended period: Provided further that any child admitted after the extended period shall complete his studies in such manner as may be prescribed by the appropriate Government.
  3. Kindly look into the matter and provide necessary relief to the child in light of above mentioned provisions of the Act
  4. Efforts should be made to educate concerned stakeholders on RTE Act
 
5.        In case, any other Commission duly constituted under any law, has also taken up this matter with you or any other authority, a copy of their communication may also be furnished.   6.        Please quote the number and date of this letter mentioned at the top while responding.

Maharamji how many vacancies you had in Kg ,i dont think its gonna make big difference as all nursery kids would be promoted to kg and handful of schools have vacancies in KG

 

Even this year implementation wont be a problem ,pls tell me the practical problems in implementing this year

Nursery students will be promoted to KG and they will join KG classes from 1st April 2012.  Leave aside transfer cases which are not more than 5-8 in a year, then where are the seats for KG. Perhaps schools with nursery class will have no advt. for this year to make seats available for KG like that of Nursery. I mean Nursery seats will be treated seats for KG for the session 2013-14 (like DPS). If others are having more seats every year in KG, they may implement the scheme.
