Petition challenges upper age limit for nursery admission

Parents with kids older than four years are finding that many schools have fixed the upper-age-limit anyway and they are ineligible to even apply.

NEW DELHI: A petition was filed in the Delhi high court on Thursday challenging the decision of a private school to fix four years as upper age limit for admission in nursery class.

The petition, filed by the father of a child, alleged that a notification of Delhi's directorate of education (DoE) mentioned three years as the lower age for admission in nursery and categorically bars unaided private schools from fixing any upper age cap for this purpose.

The plea, however said that Sachdeva Public School at Rohini, in its admission brochure, said that children, who are of three years of age and have not crossed the four year age limit, would be entitled for admission in nursery.

The petition sought an order or direction declaring the clause 5 of admission criteria for pre-school issued by the school for the session 2013-14 about fixation of upper age limit for admission "arbitrary and illegal" and striking down the same.

The petition filed by Pankaj Kumar, through advocate Ashok Agarwal, alleged that the school has refused to accept the application form of his son on the ground that the child would be over four years of age on March 31, the cut-off date for receipt of forms.

The case likely come for hearing Friday.

Birla Vidya Niketan pushp vihar, Manava Bharti International, Banyan Tree, etc are also decided to issue form for the children born between 1.4.2009 to 31.10.2010. 

Well Done Mr. Pankaj.  I have also the same problem.  Many schools have rejected my application but when I filed my complaint to DOE, I recd. the call from the schools saying pls. come and submit your form.  But this is not the end.  I have some confusion in my mind, whether they have considered my son's registration form or not for nursery class as my son is also crossed 4 years from the last date i.e.31/3/2010.

Is this decision is applicable for all the schools . as I am also facing the same problem. lets hope for the best for all parents facing this problem.

 

School drops upper age criteria for nursery admission

A city-based private school today told the Delhi High Court that it has deleted a clause from its admission brochure that fixed four years as upper age limit for toddlers' admission in nursery class.

Justice G S Sistani, who was hearing the plea of a toddler's father against fixation of upper age for nursery admission, later disposed of his application after an official from Sachdeva Public School of Rohini in North West Delhi told the court that the clause has been dropped.

In its brochure, the school had stipulated that children, who have turned three but have not crossed the four-year age limit on March 31, 2013, the cut-off date for receipt of application forms, would be entitled for admission in nursery, the plea, filed through advocate Ashok Agarwal, had said.

The plea had said the clause was not in conformity with a Department of Education notification which fixed 3 years as lower age for admission, but "categorically" barred schools from fixing any "upper age cap."

The school official today told the court that the clause will not be in force now and the administration would accept nursery admission forms of those kids who have crossed four years.

The petition was filed by Pankaj Kumar, a driver, alleging that the school has refused to accept the admission application form his son on the ground that he would be over four years of age on March 31, the cut-off date for receipt of forms.

Wat about other schools like BBPS=pitampura, DPS etc who are not taking forms from 4+ students..??

 

This order is applicable valid only for sachdeva rohini.

There has to be separate petitions filed in the High Court for different schools. In the case of Sachdeva Public School, the school itself dropped the clause fixing upper age limit before the final court hearing and therefore, the court has not ruled or made a law that the said clause was “illegal and arbitrary”. Had the court observed in its order that the clause is “illegal and arbitrary”, then only it would be applicable to all schools.

Technicalities are the bane of this country. It makes no sense that every affected parent would go and file a PIL in high court against erring schools on this point. Upper age limit cant be capped and the ystrday's event related to Sachdeva School shouldnt be seen in isolation. All schools should take cognizance of this failing which DOE/Mr. Vohra should step in and take this matter to its logical conclusion before the form submission date ends.
