No nursery admissions in private Delhi schools till final verdict, orders court

Delhi: The Delhi High Court on Monday ordered private schools in Delhi to not allow nursery admissions till it gives a final verdict on the validity of government's 2010 notification and whether it follows the Right to Education Act. "Schools cannot formulate their own admission policies," the court further ordered.
The notification allows schools in Delhi to formulate their own guidelines and preferences based on religion, sibling and alumni to admit children in nursery. The court had earlier said the Centre and the Delhi government cannot "dilute" RTE Act by allowing unaided private schools to use their own criteria for nursery admissions.
The court had also said the ongoing nursery admission process in Delhi would be cancelled if it decides to "quash" the notification issued on December 15, 2010 by the Directorate of Education (DoE) on behalf of Delhi government.

RTE has become a joke now days for parents whose kids are not getting enough points and are considering this as a boon is gonna be a biggest nightmare for all ..the schools now will again the opportunity to demand lakhs of rupees from parents for admission..guess what i feel its a shame that the gov. And our courts are so reactive that it makes the citizens of the county to sufffer as early as the age of 3...three cheers for the Govt...

Court decision is a good step, because every child is feauture a of the country thatswhy every child shuld have equal opportunity for getting their educational right.

Why are we talking about the country.... that is the joke... we are discussing about a right by the constitution of India..... but only enforced in Delhi..... where has the court spoken about stalling the admission process in the rest of the country... if they are so serious...make it a Pan India order.

Do not you think the above statement is contradictory in itself. One side the order is saying "Schools cannot formulate their own admission policies" and another side it says "The notification allows schools in Delhi to formulate their own guidelines and preferences based on religion, sibling and alumni to admit children in nursery".
What actually, they want to deliver the message to the Parents. It is totally chaos of admission. Every year this happens and they can not make a thumb rules for admissions process. How weak are our decision makers in Govt. God helps them.

Good move. At least parents can be hopeful for admission in schools in neighbourhood in case they have no transfer or sibling case. Transfer case is the easiest criteria that is being forged.

While completely understand the frustration level of parents who went through collecting forms, attesting documents, making affidavits and submitting in the schools, not just one but in the lines of 15 to 30 schools; however, please see the brighter side of our tomorrow's children! Just think about your own second kid’s admission process in the coming years!
Please believe, it’s just going to be better. There is nothing new in the HC order... the HC is implementing and re-enforcing a law which already exist basis RTE act (schools were not only not following it but also putting their own criteria) and will not only kill the entire School lobby but will make a better process for our own good. And I have complete faith in the HC order! Hats-off to the NGO and the team of AN.com who is fighting the case for the parent community and children’s of today and tomorrow!

Dear Mr. Suresh Kumar, HC judgment / verdict on admission is not enough whatever it may be for children future but to implement it in a proper way is important. As far as my experience says, the most of the schools were not following the any DoE rules and guidelines. There MUST BE a monitoring body to check each school process of admission and give their feedback to Governing body of DoE. Otherwise it can not be contorlled you can make n number of rules and guidelines, it is totally waste of time and money. Everything is in schools control they can show you all paper work as per DoE but behind scene is totally different.

Totally agree to the same... the current guidelines by DoE is an effect to enforce the RTE.... they may have missed the point, but enforcement remains the issue and a central tried and tested system has to be in place for the same... a simple re arrangement of scores cannot help the cause.

There is nothin to worry about. Even if the H.C. Quashes the 2010 notification and scrappes the admission process, parents would not be required to fill new forms , submitting them etc. The verdict would have its impact only on the "process of allocation of points based on criteria of sibling, alumni etc" . On already submitted forms, new lists will be prepared based on a new, legal and univesally acceptable criteria.
