New Delhi: In what comes as a blow to the efforts of city parents’ associations which have been campaigning for reining in school fees, Union HRD minister Kapil Sibal said on Friday that fees of private schools cannot be regulated and each school had the right to fix salaries of its teachers.
   Sibal’s claims contradict provisions in the Delhi School Education Act, 1973, which stipulate that remuneration of teachers in private schools cannot be less than their counterparts in government schools. The minister said this contradiction will go away once the Right to Education Act is implemented from April 1 — implying that it will override the state law.
   ‘‘There is no such provision in RTE,’’ Sibal said about the salaries of teachers while addressing principals at the 37th annual meet of National Progressive Schools’ Conference — a group of nearly 110 private unaided schools in the city.
   ‘‘Salaries in private schools do not have to be according to the government. They will decide what they want to pay,’’ he said, countering a speaker at the meet who had earlier said small schools did not have good teachers because they could not afford high pay.
   While all schools were not required to pay Rs 22,000 (the minimum basic salary as per the Sixth Pay Commission) to their teachers, there should be no compromise on the qualification of teachers, he added.

New Delhi: A tussle between the Centre and some state governments could be on the cards. Delhi government officials were dismissive of Kapil Sibal’s claim on fees and salaries of private schools while principals at the NPSC meet were seen asking each other if they had heard it right. Sibal may claim that Delhi School Education Act, 1973 will not apply once the Right to Education Act is implemented from April 1, a highly-placed source in Delhi government ruled this out.
   The unaided schools had last hiked fees following the Sixth Pay Commission recommendations when the salaries of teachers had to be increased in accordance with a provision under the Delhi School Education (DSE) Act, 1973. ‘‘Education is a concurrent subject and Delhi School Education Act cannot be done away with. It will be on us to amend it to accommodate the provisions of Right to Education,’’ said this source.
   ‘‘The children in these schools are the biggest stakeholder in this matter and we will make sure that their rights are protected. Schools cannot get such a free hand,’’ said this source. According to this source, Delhi government was unaware of the malpractices bill moved by Sibal to keep a check on schools which flout rules. ‘‘Since education is a concurrent subject, such a bill will have to go through the Central Advisory Board for Education of which all state education ministers are members,’’ the source said.
   The state government may be hinting at a possible clash with the Centre but the schools are keen to see who wins. ‘‘We cannot say anything till the rules come. But I cannot understand how the state education act will not apply once
the Right to Education is implemented. Many other states besides Delhi have such acts. It is not going to be so simple,’’ said L V Sehgal, principal, Bal Bharati Public School, Ganga Ram Hospital Marg, and vice-chairperson, NPSC.
   The idea of getting autonomy, however, is like a dream come true for private unaided schools. D R Saini, principal, Delhi Public School, R K Puram, said: ‘‘There must be some logic behind what the minister said. When we do not get any aid from the government, it should be left to us and the parents to decide the rules. If parents want quality education, they will have to pay accordingly.’’ Manju Bharat Ram, chairperson, Shri Ram School, added, ‘‘May be the minister is trying to reduce the number of controls on schools as controls bring in corruption. Transparent schools will not misuse autonomy but those on the management committee of a school may keep an eye.’’
   Schools maintain quality comes with good teachers and good teachers can be retained only with high salaries. Since the fees charged from students is the main source of revenue for schools, parents have to eventually pay up for any hike in teachers’ salaries. ‘‘The Right to Education has a provision which says that schools have to notify their fees but does not give any parameters on how much or how to do it. It will leave hapless parents at the hands of greedy schools,’’ said advocate Ashok Aggarwal, founder of Social Jurist organisation which is also the president of All India Parents’ Association. He added, ‘‘Parents will have to challenge its validity in court. Even a Supreme Court order says that education cannot be commercialised,’’
   Teachers from smaller schools have their own fears. A teacher from a north Delhi school said, ‘‘Some schools hire teachers at just Rs 5,000 on an ad hoc basis. Such schools will take more advantage if the pay scales are not fixed by the government.’’

i think sibal saab ko ab retirement le leni chaiye because his decision is now good for nothing.
Education is going to be more expensive...
The money will be recovered from parents seeking admission for their kids. All these new announcements in last one month - admission criteria(last minute change), age, payscale of teachers etc. give enough room for schools to play around for more money, "if not enforced properly".
I think he might be having many own schools. He does't bothered about the misseries of the public as he may be getting 2nd hand money in his pocket. so he tie-up with private school lobby.
Now School will increase more fees they want to retain good teachers its becoming like corporate house. All schools are free to make decision " If parents want quality education, they will have to pay accordingly.’’ Manju Bharat Ram, chairperson, Shri Ram School, which means good education will be domain of rich only. Getting admission itself is such a hassle if you can afford it or not if you can't take the kid out of school. Aam aadmi in the language of politics what will they do infact what will they eat half salary goes in taxes then education and inflation how will anyone is going to survive. Mr. Sibal please wake up
This is a real face of Congress Party, very terrible, please explain me who is realy responsible for price hike, who is responsible for getting education in right way. Sibal of Sheila ka dimag kharab ho chuka hai, agar jaldi hi kuch nahi kiya to ab apne ghar me marne ke liye bhi charges padenge!!!!!
He might be getting his own fees from these private schools. So, probably he has spoken this taking his own into account. I agree there need not be a regulatory body above these schools but there should be one on ministers issuing such rubbish, irresponsible and crazy statements. Now it seems Arjun Singh was better suited for the post. He was having stake only in higher studies but Mr. Sibal is having his stake even in primary schools.
In this whole bloody world only Ms. Manju Bharat Ram knows what exactly is quality education. By spending quality money only one can get quality education. If quality education means AC Buses, AC Classrooms, Foreign education tours, expensive gadgets, teaching through laptops, deploying room size plasma panels, hiring useless and good for nothing consultants and trainers then first there is an urgent need for these educationists to go to some good school.
This is the problem of globalisation and privatization in education - no problem in paying good salaries to teachers but there should be cap on the profit making for these corporate schools. It urgently asks for an urgent audit of these schools. They should not have a free hand like this. Already the fees is beyond the affordable range for most of the parents. They are paying through neck and people like Manju Bharat Ram want to snatch even the daily meals of parents.

Sir ,
I think u are doing the same job as Mr. Sharad Pawar . He made statements recently showed on a news channel before the SUGAR PRICES SHOT FROM Rs.25 to Rs.45 in time span of two months .
His statements made sugar prises rise so fast . You are doing the same .Making Schools increase their fees .
Kindly do not make any statements like this . Govt. should have their control else it will be difficult for people to educate their children .
I think inflation figures should be calculated taking school fees into account as well.
Monthly household budget is affected by school fees as well.

After this ruling private schools fees is for sure going to increase and this will further add to suffering of parents already on the edge for not being able to get admissions in anyschool.

Instead gvernment should ask schools to add more teachers and classes so the schools can accomodate more children seeking admissions and lessen the worries of parents.
I know - he was our law minister in last govt. Apart from some statements I found him a logical and good politician. Probably the gathering with PVT schools influenced him to issue such a statement. Or may be we interpret his statements otherwise.
Anyway, it's good that he reverted his statement a say after.

Dont u know that yesterday minister had sumptous food to match his appetite at this get-together in lavish NPSC meet organised by school lobby where he was chief guest and he was full stomach when his turn came on the dias and was having severe dyspeptic symptoms.

pls dont mind his verbal diarrhoea mixed with farts.

Today he has started recovering from the illness and now covering up.

Remember he is a seasoned expert lawyer cum vocal politicians ( the most deadly lethal cocktail of all professions) and knows very well how to interpret the laws/rules and guidelines as per clients needs.

Let any parents association (if there is any strong lobbying association) call him as chief guest see what he comments.

I think Kapil Sibbal do not want a middle class family get their children good education,as everyone want their child to get educated in good school.If school administration are free to fix their fees,then it is a big loss for parents.Govt. should not allow schools to do so.I think all parents should get a united And strike against the decision made by Mr. Kapil,so that he could realize what he has done.Though Govt. wants to make education for all,I don`t think people will make their children study in any private school and they will get their children admitted to a Govt. school.
