NURSERY ADMISSION TROUBLES DON’T END YET

New Delhi: There may be more legal action coming on nursery admissions. At least some transfer cases may go to court, not against the withdrawal of points, but against the decision allowing some to hang on to their seats.
Waitlisted candidates, too, are anxious. The guidelines, they say, don’t clarify whether existing wait-lists are to be scrapped while its members participate in other draws.
“I made sure I moved in time for the admissions,” says Kumar Saurabh who moved from Mumbai in 2013. “I got new voter ID cards, changed the address on my wife’s passport and updated our Aadhaar cards. I wasn’t expecting any points for transfer. But I saw the new guidelines were good.” Figuring that the points for transfer improved his chances significantly, Saurabh applied to a “limited number of schools”. His son was selected at three.
Saurabh informs that schools, especially after protests over transfer cases, became so vigilant that he was asked to furnish many documents other than those prescribed by the Directorate of Education. “We thought the first guidelines were progressive. Later, we believed when DoE scraps transfer points, they’ll come up with something rational. They haven’t.”
His fears coincide exactly with 70-pointers (applicants with only distance points). “At one Vasant Kunj school, there’s a draw for hundreds of 75-pointers for 63 seats. If you remove transfer cases, the batch will be of siblings and alumni,” Saurabh says.
Several parents and activists have been demanding “capping” of the number of seats that can go to these categories. “You should have similarly scrapped 20 points for sibling and five points for alumni or at least a cap should have been put on them as suggested by the Ganguly Committee in its IInd Report to the Delhi high court in 2007,” lawyer-activist Ashok Agarwal wrote to the LG on Friday.
“Parents with genuine transfer points say they will get one chance in the lottery while others will get more. Since technically all lists are provisional, on what ground can waitlist candidates be rejected?” Sumit Vohra of admissionsnursery.com says.

New Delhi: The Delhi government on Friday informed Delhi high court that it has done away with points for interstate transfer cases of children seeking admission in nursery classes.
“The writ petition was essentially filed against the grant of points reserved for interstate transfer category. The Delhi government informed us that the provision of five points for interstate transfer cases has been done away with and a fresh notification been issued. In view of this, no further direction is needed. The writ petition stands disposed,” a bench headed by acting Chief Justice B D Ahmed said.
During the hearing, the bench asked petitioner Rohit Nagpal and other parents not to widen the scope of the petition by challenging other admission criteria. It, however, asked the parents to approach the single judge bench for other grievances related to the nursery admission process. The single bench, which was hearing a similar plea, had disposed of the petition.

once transfer cases come back to 70 points group, redraw excluding selected cases of 70 points is not right.now more numbers are there in 70 point group.those selected earlier were from smaller group of 70 pointers.!!!so fresh draw with all 70 pointers is scientifically right.

Right - try that and be prepared for countless litigations.... This fight isn't going anywhere. The govt. cannot revoke seats that parents have won in a fair manner, irrespective of criteria

Provisionally selected applicants by the schools before the scheduled date by DoE can be revoked by Gov any time before due date if selection rule has been changed by DoE to offer equal opportunity to all the applicants applied for. Let's wait for court judgement further in this regard.

And you think this will be the last court judgment? That there will be no backlash if you try and snatch other parents' seats? Sir, there is no end to this madness. And the DOE is equally answerable to parents who have got seats through lotteries in a fair manner. Rest assured that there will be many more PILs and many more judgments

As far as RTE(Right to Education) is concerned the RTE doesn't mean that the Root to Education start with gambling kind of draw process where there is no place for the kids of educated parents if not selected in draw. So there has to be transparent & authentic system of choice rule in which 50% open seat must be offered by draw to neighboring parents with sibling/alumni criteria and rest of the 50% seats must be filled by interviewing the educated parents depending upon high profile of parents but not their innocent child screening. So that kids of both the highly educated parent and less educated parents could have fair and justified chance of equal admission opportunity to their wards in affordable schools.

Agree with your statement though. Still feel that it is coming slightly late in the day. Where were all these opinions when the guidelines were formulated in Dec-13? Why is this activism happening now? And please, no one cares for the collective benefit of the society. Everyone is trying to modify the guidelines to suit their child's need.

We as parents of innocent kids are ultimate looser because this much effort of almost an quarter can contribute hard working parent to their next level of growth, however what is going on misleading to big zero no result with limited scope under dark clouds of experimental decision making of concerned higher authorities.

ms jyoti earlier draw for 70 pointers was not within small group .The draw was among 2000 to 3000 aplications that only for 4,8,11,30 etc seats.Some reputed school even dont consider 70 pointers.

If redraw for all why we don't fight against Alumni .. Sibling I understand valid category but then why alumni reservation?????

Why is sibling a valid category? There are people who haven't got a single seat here. Do you think that just because you have a sibling, you should be guaranteed a seat? Sibling points serve the same purpose and have a similar logic as alumni points. So they should also be questioned. Also why should there be a girl child quota? Please question all parameters holistically. Don't try to bend rules for your personal gains
