Nursery Admissions - Delhi HC extends stay on nursery admission till April 2

HC extends stay on nursery admission till April 2

New Delhi, March 28 (IANS) The Delhi High Court Friday further extended stay on the nursery admission process and fresh draw of lots in the capital's schools till April 2.

A bench of Acting Chief Justice B.D. Ahmed and Justice Sidharth Mridul also declined to entertain a petition filed by a set of parents seeking to scrap the alumni and sibling categories.

The bench allowed petitioners to withdraw the plea and approach the single judge which was hearing the main case filed challenging the lt governor's notification.

After the court refused to entertain the plea seeking scrapping both the categories, the five and 20 points under alumni and sibling sections will be retained this academic year.

The court's order came after the education department submitted data which showed that a majority of the children admitted in the first draw of lots belonged to 70 pointers who came under the neighbourhood criteria.

Senior advocate Nidhesh Gupta, who is representing another group of parents, said that the alumni and sibling points were a valid classification which has been recognized the world over.

The court is adjudicating the contentious issue of whether a fresh draw of lottery was necessary after the scrapping of the inter-state transfer points on Feb 27.

At present, 95-point system is followed for admissions -- 70 points are allocated to neighbourhood criteria, 20 to sibling and five under alumni category.

Honestly, I fail to understand. Can anybody tell me how this works: Can an individual just walk into the sacred corridors of our esteemed judiciary and "file a PIL" in the High Court as if it was simple as asking for a cup of Tea from your company Chai-Walla? Something to do when not working? Something to stir up matters when you're bored? Just to get some attention?

Should there not be a restriction on WHO can file PILs or some kind of a Check on Whether a cause is fit to be considered by HC? Also, is it Free of cost?! OR can I take up silly matters between me and my neighbour and knock at the court's doors everyday to intervene? Worse than children, even they try to sort their matters among themselves before running to Mom-Dad.

On a philosophical note, I fail to understand Why we choose Retardation over Sanity, more often than not..

I have a feeling that these odd parents r just trying to play & nothing else. The admission process is under DOE & LG & nothing can be changed. I don't think that HC will challenge LG.

Hi Gitanjali,

Its ridiculous and really its sad to see that set of 10 odd parents can play with the entire government, parents and judiciary and make use of it.. Shows the weakness in our system and process. Nothing gonna happen today. Wrong example was set by the decision of removal of transfer points rather than taking action against parents who submitted fake docs. It encouraged these 20 odd parents and they will fight till their kids get admission in so called TOP SCHOOL. All they say is they are fighting for a cause but I fail to understand the cause. They are fighting for themselves and at the end no one is benefiting.

I wish there was a solution to this vicious circle.

Rgds

Mr. Jain joined this network on Feb 10. Same day he left messages in all major threads to ask parents to join him for a "Peaceful Protest" at Jantar Mantar. When that did not work, he tried Media/Political circles/placards to "Raise Protest" and "Fight for our Rights". He also left msgs to everyone to write to Manish Sisodia. When that too did not work- (delhi govt took off!), he went ahead and filed a PIL.

At NO point, from Feb 10 to the day he files a PIL, did Mr Jain explain WHAT rights he wanted to fight for, or WHAT protest he wished to raise, most of us assumed that he too, like us, was tired of the PIL-PIL, but Lo and Behold! HE has gone and filed one for himself! And By the way, nobody knows his grievance. Is that Ridiculous or IS THAT RIDICULOUS.

Thank you Mr Jain, for taking out your vengeance on us parents only!
