Why draw of lots in nursery admission be not held afresh?: HC

The High today asked the city government to inform it why draw of lots in nursery admission be not held afresh for all seats under neighbourhood scheme instead of just for those seats which were vacated after inter-state transfer category was scrapped.

Justice Manmohan asked the counsel for the government to take instructions from the directorate of education and listed the matter for further hearing tomorrow.

The court was hearing a plea against city government's decision to do away with the system of allocating points to inter-state transfer cases of children seeking admission in nursery classes here.

Delhi government had on February 27 issued a notification scrapping the inter-state transfer category under which it used to give five points to children whose parents have been transferred to the national capital from another state.

The notification was issued by the government after it admitted in court that there was misuse of the inter-state category.

The petition challenging the February 27 notification as being "totally arbitrary and unjustified" has been filed by Major Saurabh Charan and some other parents who have sought quashing of the government's decision to do away with the inter-state transfer category.

The petition has also sought directions to the government "to confirm the list of successful candidates/applicants including the children of present petitioners published by the schools prior to the passing of the impugned notification/ order..."

In the alternative, they have sought that draw of lots be conducted afresh for all seats under neighbourhood category by cancelling the entire draw held prior to February 27 and not just of those children who had availed of the benefit of the inter-state transfer category.

Under the earlier system, out of the total 100 points, 70 were given if the child lives in the neighbourhood of the school, additional 20 were given if a sibling is studying there, five points more if either parent is an alumni and another five points if it is an inter-state transfer case.

Those having 90 or more points are directly admitted while the rest have to undergo the draw of lots for admission.

Agrre with you... give 5 pts to single child and my point of supporting sibling is that if one kid is going a school other should also go to the same school

i think DOE should scrap all the points, parents can apply in schools and for everyone be it sibling/Alumni/Distance there should be a common draw where every one is treated equally.People were not happy with transfer points now we r not happy with alumni etc.. this is a never ending debate. 

What about the parents having twin like me my only hope of both the kids going to the same school is via sibling that is if one of them gets selected the other will get sibling points. With no sibling points twin will never go to same school and will be a cause of lot of problems for the parents having twin

For twins there should be single application entitling them two seats....but no sibling points should be awarded in general.

Even siblings should be treated as a capped quota...freeing the remaining seats for general population

@ Qaisar Alam: I can see the sourness in your heart and everyone else's against the alumni points system. But if you try to see beyond the obvious you would realize sir that awarding 5 points for alumni is not the root cause of the problem. And similarly removing it also is not the cure. Alumni deserve every bit of advantage to their school and they have been getting those points year after year since the points system started. But it was only this year that the way the points system is framed, people started to realize that mere 70 points will not get them anywhere. 

This entire system of awarding points this year was so that every child gets a chance at every school in the neighborhood. But while doing so every parent thought that because they had a chance at the likes of dps, springdales etc. with 70 points, they started feeling that they had a right to that school.

Thats not how things worked this year. What we got is a whole lot of unhappy parents, because everyones emotions were quashed when the draws came out. Only the parents who were smart enough to make sure to apply to schools where they got those 5 alumni points are now content that at least their child will have an option from 2 schools.

Alumni Points are constitutionally untenable. This is repugnant to morality and sense of justice. Sati Pratha had been there for centuries, but it was finally abolished by the government of the time as it failed to get justified by any rational arguments.
To be alumni is good, but why should it be converted into a tool of nepotism and favouritism which denies the participation of a vast majority of kids having no privilege points (like alumni and sibling).
So, alumni criterion is going to be proclaimed as illegal, unconstitutional and damaging to the spirit of making India into a participative and inclusive democracy even though this atrocious and violative practice has been going on for years (as you point out). We are going to fight this atrocity and blatant injustice in highest level of judiciary. The time has come to give it a decent burial.
Let us liberate India from the clutches of a select club of crony elitists and snatchers of opportunities from the tiny hands of our kids, kids of common people having no privilege points. We will fight for our kids. We are from the land of Gandhi, and know how to get justice. 

Sir you are still missing the point. The reason i so much as support the idea is not as if i went to the top school in delhi (because I didn't). I am only saying that if the govt preparing the guidelines were not as short sighted they would have realized that they are in the true sense playing with the emotions of us parents. 

From the time these points system came out, I was sure that the only 2 schools that I would possible have a good chance at are the ones in which we can get anything over 70 points. Because 25 seats for 3000 applications isn't really a chance. Even according to the law of probability for a 1% chance to succeed, in this case, we should have applied to at least 101 schools. 

I don't think any of us has done that. These points system were deeply flawed from the very beginning. And hence we (70 pointers) feel violated because everyone above 70 points is bound to get a sure shot admission. Those extra points unlike the earlier years have just made the difference of getting admission and not getting admission. 

Its not like till last year, all alumni got admission in their respective school. Other factors played just as important roles. That was not the case this year. 

If there is sibling point then there should be oopurtunity given for the first child.

Otherwise, scrap all points except neighbourhood point.

agree 100%.....all points other than neighborhood should be scrapped....making the system fair to all
