Justice Valmiki Mehta relied on provisions under Delhi School Education Rules, 1973 to clarify that an unaided recognized private school cannot charge fee for more than one month from the parents. Also, the parents are entitled to deposit the same by 10th of the month when the fee is due. HC further held that the Director of Education has no authority in law to allow an unaided recognized private school to charge fee for more than one month. The court made the observations while taking note that some schools demand fee be paid on a quarterly basis posing a problem for the parents. The court gave the order on a petition filed by 10 parents whose wards are studying in Summerfield School. Unhappy with being asked to deposit fee on a quarterly basis, the parents, through their lawyer Ashok Aggarwal urged HC to end the practice. Agarwal highlighted how many unaided private schools in Delhi compel the parents to deposit fees on quarterly basis in complete violation of the letter and sprit of the Provisions of the Delhi School Education Act, 1973 and the Rules made under it. The parents argued this amounts to exploitation and commercialization of education, which is prohibited by the law. “Most unaided private schools have now started insisting parents deposit six months’ fee in advance. Some have even gone to the extent of insisting parents to deposit full year’s fee in advance. Such practice on the part of the schools is anti-child and violates fundamental and human rights of the parents as guaranteed to them under the Constitution” said Aggarwal, pointing out how schools enjoy interest on the money taken in advance.

ools, management quota seats are not given based on "donation". We had applied to about 25 schools in South Delhi, including Bluebells, but we got rejected in all schools except Cambridge NFC. In some schools, we were rejected directly and in a lot of schools, we got rejected in the lottery. After we got rejected in all our top preference schools, we did the following: 1. We made a list of 6 schools that are better than Cambridge and were higher on our priority list - DPS Mathura Road, SPV, DPS EoK, RSJMS, Tagore EoK, and Bluebells. We then focussed all our efforts on only these 6 schools. 2. We wrote an email to these 6 schools. In addition to the email ids on the school website, we researched on google, LinkedIn, etc. to find the Principal's email id. In the email, we wrote about our academic and professional highlights and accomplishments. We did not write about our income or wealth. We specifically asked the school to reconsider the application. We ran the content of the email through MS Word Spell-check and Grammarly to ensure that it is completely error-free. 3. We formatted the content of the email into a letter and sent the letter to the 6 schools by Speed Post. We also dropped the letter at the schools. SPV did not take our letter. 4. We got calls from Bluebells and Tagore EoK for an interaction a few days later. In both places, they had the letter in front of them during the interaction. In Bluebells, it was not required to take our daughter. They asked about our profiles and how we spend time with our daughter. They also did document verification. In Tagore EoK, we were required to take our daughter and they spoke mainly with our daughter. We also got call from Summerfield for interaction - without trying. We did not go there. 5. Bluebells gave us the admission offer on the day of the interaction itself. Tagore EoK said that they will let us know. Bluebells was higher on our priority list. So, we took admission there. he process of refunding excess fees, including around 70 schools that have submitted the respective amounts to the high court. But certain big schools like DPS Mathura Road and Springdales Pusa Road have approached the court separately over the issue and are waiting for its decision before making any payments. According to lawyers involved in the case, while a concrete number cannot be given to the number of schools that have started making refunds, around 70 schools have made the payment to the court and the rest have started the process of issuing cheques to parents. Delhi government had served a show-cause notice to 449 schools on Monday , giving them two weeks to refund excess fees charged by them. This was suggested by the Justice Anil Dev Committee.The government, in the notice, had threatened to take over the management of the schools in case they failed to pay the amount due to parents.Recommended By Colombia
Schools like Oxford Public School in Nehru Nagar and Smt Misri Devi Gyan Niketan School in Deenpur have already invited parents to submit their bank details to facilitate the transfer of funds. Cheques have also started arriving to parents from Modern School, Vasant Vihar. The schools that have started making the payment to the court include DPS Vasant Kunj, DPS Dwarka, KR Mangalam World School, Summerfields School, Sanskriti School, among the 70-odd. However, DPS Mathura Road, one of the schools served the show-cause notice, is waiting for the decision in the high court. "There is a PIL that we have filed in court and are waiting for a decision. We have the amount ready with us. The hearing is next month, and action will be taken on the direction of the court," said principal Manohar Lal.

The parents want strict actions by the government against on complaints filed with DOE against schools for not following the government guidelines. Some of them include:
Salwan Montessori allocated points for achievements/profession of parents(which amounts to be screening of parents that is banned under RTE.)
Modern School Humayun Road and Vasant Vihar branch both did not disclose any point system for nursery admissions.
Vivek Summit/ Kidsway did not follow a transparent admission process
Bal Bharti (Rohini & Dwarka) had a non transparent draw of lots.
Laxman Public School and many others conducted draw of lots in the absence of parents (in case of LPS candidates for lottery were more than 1000)
K R Mangalam giving admissions to few parents with 70 points but others with 70 were not admitted (.Moreover on the parents on confronting the school authorities were told that it is a school management decision and they have to abide by it.)

Many schools including the above have not published the breakup of allocated points for the applications received.
Summerfields, K R Mangalam, Vivekanand and many other schools are giving admissions on first come first- come-first-serve basis·
• Tagore International school has mentioned on its website that FEE ONCE PAID WILL NOT BE REFUNDED(Which is totally against DOE guidelines) and many other schools are doing the same, taking fee in cash and not giving the receipt. Doe should issue new circular for fee refund policy again immediately (Schools are giving excuses that there is no clarity/notification on fee refund policy this year)
Further the parents want to propose a Centralised Point System with centralized admission process with following salient features:
1. There should be one common form which should be filled by all parents who are seeking admissions for their kids, online/offline. The form should have all the required details and a few preferred schools.
2. It should be submitted to the DOE or the any concerned impartial authority.
3. Based on the details given by parents, the authorities should assign schools to each child (each child should be given a choice of 4-5 schools to choose from).
4. After this list is out, the parents should choose any one school and submit the same.
5. Once the list is final, the schools should be sent the list of the students who have been admitted in their school.
6 Scrap Alumni Points( Against RTE as alumni is educated till 12th so profiling against uneducated under RTE )
7 Transparency etc
8 .Strict action against all (schools which flout guidelines)
9. There should be a uniformity from sale of prospects to declaration of selected
candidates.
10. Upper Limit of fees should by schools to be fixed.
11. Any guidelines should be analysed before implementation.
12. No child should be left out without admission.
